Ful medical filled out by a Civil Surgeon using the I-693 form. You could say this is the cost of not doing the AOS within the one year time frame. Even if you file given the time to get the NOA1 then for them to look at your file you MAY have to redo the medical anyway--it will be up to the person at the USCIS and that is who really matters. File the AOS ASAP before the medical expires and see whether you get an RFE for a new medical--that will run you about $150-350 depending on the Civil Surgeon.

Good luck,

Dave

so your saying i have to see a civil surgeourn either way to fill out the i693 form ?

and then send in paper work and hope it gets approved before 1 year expiry . And if it gets approved it gets approved and if not i have to go back to a civil and pay 150-350 for another medical.

i think i might risk it and save the money and fill ASAP if we can come up with the money

A medical exam is valid for one year, whether it was done by a panel physician abroad or a civil surgeon in the US. USCIS will extend the validity of the medical exam indefinitely IF the medical exam was not expired at the time USCIS accepted the AOS petition (i.e., the day the NOA1 is generated), and IF there are no class A or B medical conditions discovered during the exam. If the medical exam is expired when USCIS accepts the AOS petition then a new medical will be required

When are you planning to submit for AOS? Before or after your current medical expires?

If it's been a year since the medical exam in Australia when you submit your AOS, then you'll have to get a new medical done by a civil surgeon here in the US, and they will fill the I-693 form in completely. However if you've had the complete vaccinations and provide the records of these at the medical then you won't need them again. It's possible you might need boosters of some though. Try to look around for a "good" civil surgeon (there is a thread here in the AOS forum), that won't insist on tests and vaccinations that you don't need. Also if you have medical insurance, it's possible that your insurance will cover the medical.

If you file before your medical expires, then just send in a copy of your DS-3025 and hope you are never asked to get another medical done. If you file after your medical expires, you will need to see a civil surgeon and have a whole new medical done. Bring your DS-3025 with you to the civil surgeon. You do not have to redo the vaccinations but they will need to transcribe them onto the I-693 since it will need to be filled out completely. They will let you know if you are missing any, like needed more than 1 in a series or need a booster. Most likely if your vaccinations were all given and complete at your K-1 medical, then you probably won't need any now but the civil surgeon will let you know. You will need the full medical exam over again though.

  • 2 years later...

Me and my wife have a similar situation. She arrived in December of 2013 and we sent our AOS packet the beginning of February. Around June we received a letter from the USCIS about interview waiver selection and notified us our case would be delayed 6 months to 1 year. On December 23rd we received a intent to deny letter asking for our medical examination record which we did indeed send but expired on 8/31/13. She originally had it done in the Philippines. So that brings me to my question. Since they were so slow with our case do we now have to have the examination done again by a civil surgeon here and send it with the I-693? To give us a notice of denial and a 33 day deadline to submit the I-693 seems absolutely ridiculous. We're gonna schedule it Monday and hope we have enough time. Me and my wife are both kind of freaking out about it. Not sure what happens if they decide to take their time on this as well :(

Somebody else over in the main 'Notice of Potential Interview Waiver' thread has just had this happen to them too. It's a disgrace.
