Hi, I am in urgent need of solution. My Husband (USC) filed i130 for me last year which has been approved and I have my interview in coming month. We thought our daughter will be covered on the same petition. But we were wrong. I want my daughter to come with me. I cant leave her here. What should we do so that she get any kind of visa to accompany me.

You can't use a tourist visa to immigrate, so her application will be denied. Try getting a I-130 for her and requesting expedite based on your place in the queue. Good luck.

Only an immigration visa would allow her to accompany you.

It is illegal to use a tourist visa to enter the US with the intent to immigrate.

Your mistake is unfortunately a common mistake. The best fix is for your husband to file for your daughter and request an expedite. The other step is to slow down your process by delaying your interview so your daughter's case can catch up to yours. This would allow both of you to immigrate together.

My husband is going to file I130 and request an expedite. We have true reasons like:

1 Nobody is here to take care of my daughter if I leave without her as my mom have some problem in her legs and she barely can walk all time. I can show them (USICS) all her doctor's prescriptions, x-rays and reports.

2 That my daughter is very close to me only as my ex-husband left us when she was 6 months. I am the only one taking care for her. (I know its the same bonding between a mother and child).

3 As she is just 8 year old there are no chances that she is involved in any doubtful activity. Moreover my i130 is approved.

But I can even think about to leave without her.

Please suggest if there is something else we can do to make our expedite request strong?

This is what we are planning to do:

we want to contact the senator first >

get a letter from their immigration team that our reasons are valid and we should get help >

then put the expedite request as cover letter with the letter from senator >

File the i130

Is this the right way? :help:

We are in a new problem now.

California Service Center has sent us a letter saying that they have transferred our case (I130 for our daughter) to National Benefit Center.

After 2 days Our case status says:

The I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN was transferred and is now being processed at a USCIS office.

Does it mean that it is back to California Service Center?

There was no error in the form and we stated that our daughter is still living in India. We were about to send an expedite request also. We dont know what to do?

1. Is the case transferred to NBC to speed up or its a mistake?

2. Can we still request to expedite the case?

Please help to understand this "World's most Complicated Immigration Process".. :(

This has been happening to people who filed in August for an immediate relative. There are a few threads about it in the CR/IR-1 forum, one of them is called "Moussouri" or something. It's unclear if this is a mass error, or if they are trying to share the burden with another service center. Did you request expedite?

Hi all,

I have a question. Kindly answer. I need to prepare the Packet 4 to send to NVC soon. I dont have a custody decree but I do have my Divorce Decree which says that I have my daughter's whole sole custody and I have all the right to take any kind of decisions for her. She is 8 years old.

Question is: Is it ok if I send the Divorce Decree as Custody Decree as that is the only document I have which is a legal document and says everything about her custody?

I dont want to get stuck now as we are about to get done with immigration.

Just notice your reasons for expedite are pretty weak - no one forces you to move without your daughter. No hurt in trying, just don't see that happening
