Hi - I have filled out all the forms and gotten together everything we need for me to send off for my AOS - EXCEPT the Affadavits of Support.

My husband is a student and can not sponsor me as he has no income. I realize he still needs to fill out an I-864 as he is my visa petitioner/sponsor, but his mother will be the person whose income we rely on. Will she fill out a second I-864, OR will she need to fill out an I-864A?

Please help - thank you.

Your mother in law will need to fill up another I-864, you should have 2 I-864, one filed out by your husband and one filed out by your Mother in law and the I-864A should fill out by your father in law..

Thank you very much - my father-in-law is not currently working, so his income will not be factored in; does this just mean that only my partner and mother-in-law fill out an I-864 each and my father-in-law fills out nothing at all?

I-864A needs to fill up by a household member, because the household member will agree that your sponsor really have that asset to sponsor you by filling out the I-864A.

If your mother-in-law makes enough to fulfill the income requirement for her own household size plus you, then her husband has no need to fill out an I-864A especially if he is not working and has no current income. The I-864A is for a qualifying household member to combine their income with that of the sponsor filling out the I-864 to reach the 125% income requirement together. That is not the case here and it is not needed. Your husband fills out his I-864 and provides his supporting documents, and his mother fills out her own I-864 and provides her supporting documents plus proof of being a USC or LPR.

Your mother-in-law provides her 2011 tax transcript, even if filed jointly with her husband. She will simply list her own individual income for the past 3 years taxes(#25 of the I-864) and provide a copy of her 2011 W-2 to show her separate, individual income.

Oh ok.. Because in my case the lawyer told us to filled up I-864A even if my mother in law has enough asset to reach 125%..

hello, i am in a similar situation

I brought my fiance on a k1 visa

i am applying for the adjustment of status for my husband

i filled the I 864 for myself even though i am a full time student and i do not have any income and i am relying on my father who i also filled an a I 864 for him and he ( my father ) has the 125% income requirement.

i am confused do i need a i 864A for my mother or is what i have is enough

The mother does not have to fill out an I-864A, if the father makes enough for joint sponsorship on his own. However, if she is willing to fill out the I-864A to go with her husband's I-864, then she probably should. If the father sends an I-864 without his wife submitting an I-864A with it, then be sure he follows the I-864 instructions and sends a copy of his W-2 with the IRS transcript of their joint taxes to show his individual income from joint filing.

hello everybody

i have gotten an RFE saying that the I-864 for the joint sponsor has a mistake the names in the page 1 and page 3 are not the same

so i have a couple of questions

it says that i must submit the form I-864 with the supporting documents which is fine

but the thing is i found that there might ( i am not sure if i am right) be another mistake which is in I-864 for my wife ( petitioner) in part 5 item 7

and what i did is i put 2 and did not submit two I 864A,  i submitted only one between my wife and the joint sponsor which is her dad

will i have another RFE and is what i did a mistake or could that not be a problem 

thank you soo much for every help i get thank

will i have another RFE and is what i did a mistake or could that not be a problem because my joint sponsor excedes the poverty guildline thingy and should i submit an I 864 for my wife which is my petitioner with my response even though on the RFE it says joint sponsor
