student visa while k1 is going

I wanted to send my fiance to english school just to polish her english up a little. I originally thought she's just go in the philippines but then I realized it shouldn't be too hard to get a student visa to go to an english school here. I'm just not sure if they will not like it while a k1 visa is going. I think the schools do most the work and at the end of the day it's better her learning english here than there. Has anyone done this? I'm told student visas are very solid, not sure if they are fast though so she might already be here by then. There's a good school I've checked into but not sure if they'd sell the correct story to me.

Please refer to the "Yes, you can visit" stickie at the top of this forum for details. She would basically be attempting to "visit" for a specific purpose. It is a good question if she will be granted a student visa, while a K-1 process is ongoing. Another option may be to get her a copy of Rosetta Stone software for English.

First question, why can't she learn english when she gets there on a K-1?

Secondly, the school doesn't do most of the work, your fiance still will need to interview and prove substantial ties to PI and substantial $$$

Thirdly, she has immigrant intent, she won't be granted a non-immigrant student visa

Forth, why can't she attend English schools in PI

And finally - student visas are not immediate, they often take as long, or longer, than a K-1

Stick with the route you are on, don't complicate your case any more

You should do some investigation of the student visa process.

i tried that..same reason too ... but denied since i have USC boyfriend that time (now fiance) it's fast.. you can get the papers from the school two weeks then schedule your interview and you can get early dates too and they don't mind her applying student visa but i'm scared that they may denied it 'coz of your K1.

My wife and I have our son in a private English School in Philippines. Very affordable ($550 per year). When his English becomes sufficient to come here, then we will file petition for him.

Under these circumstances, the student visa option would more than likely be turned down.

To get a student visa, one must also have a residence abroad and no intention of abandoning that residence.

With the K1 visa going on, the current intention is that she will be abandoning her residence abroad as soon as she is approved.

As a side note, MOST student visas are giving to applicants that are seeking some sort of degree. These applicants have extremely strong ties back home with families that are showing the financial support needed.

Perhaps you can enlighten me, but I am a bit surprised why you would want her to go to an English school. Most Filipinas can converse in English anyway. There is no requirement in the K1 process that she has a degree in English.

Student visas don't require the same degree of proof as other tourist visas. As long as the school has already been paid for and they have proof of money for living expenses for the time they would be here. I do think the k1 will muddy it up though I found out from a friend who did it to get a girlfriend here after I filed the k1. The wait for a student visa is very short, quicker than tourist. And yes filipinos speak decent english, but not decent enough to get a admin job here in the US, I'm hoping I can get her up to speed to work for my company. Otherwise there's not much hope of a job for her in my area. Thanks for the help, I may have just been a little late in exploring this option.

You are partially correct with Student visas don't require the same degree of proof as other tourist visas.

The second sentence is not entirely correct. There is more to an approval of a student visa than school being paid for and proof of money for living expenses.

See here, specifically the "qualifying for a student visa"

The questionable part will be the first qualifying statement. How will the person in charge of approving this visa interpret the I-129F application that was just filed for this person? They very well could interpret as an intent to immigrate which would disqualify the student visa. As of right now, the intent to immigrate is clear with the I-129F petition. You are just waiting for approval to file the K1.

But, feel free to go for it. You may very well get it approved. Let us know how it goes.

For student visa she will have to apply for the school and school will have to grant her admission.

Than she would be required to show she has enough ties to her home country and she would return home after he studies are completed.

Than she would be required to show she has enough funding covering her expenses.

There are few thing that would not work in your case… 1st you might be little late as fall semester should be starting very shortly, 2nd she has immigrant intent (K1) which means either she is lying on her F1 application or she has lied on her K1 application.

At end of the day its your call to apply for student visa or not.
