Can you revoke a withdrawal??? HELP my friend

My guess is that any hope of cleaning up this mess would involve the USC being in Lagos at the embassy if another interview was scheduled.

I'm sure this happens occasionally throughout the Embassy world. But Lagos is its own orbit. Given the original CO's doubts, then the USC stating it's sham, there is a long, difficult road ahead.

If I were betting my money, I'd buy a beer and sit back to watch it unfold.

What was stated in the letter, just I want to pull my support of the case because I think he is using me or did she provide details as to why he was using her ? It would be harder if she provided details in the letter ( hard meaning probably impossible ) They may be in a place where she will need to spend extensive continuious time in Nigeria with him to overcome the letter.

I asked her and she said she said this in letter:

"No fraud mentioned, two sentences, I wish to withdraw this petition. This is not a bona fide relationship. That was it".

So if you want to get technical you have a USC admitting to a false relationship on a returned petition. Most immigration officers would view that as a person that was afraid they were going to get caught at providing an illegal immigration benefit and fessing up/cancelling to avoid further investigation into the relationship. Will she be able to convince a normal immigration officer that is was just a spat and she didn't mean it ? Maybe if she is very very lucky, will she convince Lagos, highly doubtful. With only 3 weeks of visits ( when was the last one , has she gone back since the letter ? ) It isn't going to look very convincing. She will need to spend time ( read that MONTHS ) in Nigeria if she is serious about proceeding and wants a chance in h-ll of getting approved .

This will not be over quickly. You will not enjoy this.

NigeriaorBust you are so right and I know I am putting on my CO hat and have said to her since she said the letter was never to have been mailed however like I said your intent of where the letter was going is no matter. You wrote it and as a CO looking at this - would have to say, if you didn't mean it what kind of marriage is it that a person can say such a thing about their marriage because they were upset. Like of all the embassies on earth to do this. Oh my.

I painted the scenario of the hole in the dike and there's nothing you can put in that whole to stop the bleeding.

This IS a job for GOD!!

I thank you for all your input. Now really NigeriaorBust in all your studies and stats have you ever seen this one happen?

I will keep you all abreast of the situation. This is something to learn from I feel and well maybe help others.

Nigeria is a place for all the extreme stories. Many other places you have a fight and you can visit and make up. Cost make Nigeria one of the harder places to do that. If the woman wrote the letter on a different day than she sent it , there is somoething seriously amiss with the relationship. It is one thing to in the heat of an agruement to do something stupid ( and you couldn't get more stupid at Lagos ) than it is to write the letter , sit on it and still feel you need to send it. I have a feeling there is no saving the current petition. It will probably be closed with fraud markers all over it.

Did she have to send additional evidence for the reaffirmation or did it just "happen" on it's own .

This will not be over quickly. You will not enjoy this.

Well the reaffirmed happened not without lack of trying but I am always puzzled at why some who get reaffirmed and get the letter of why they were denied and others like in this case just got denied. Due to "for immigration purposes". No evidence ahead of time have been requested.

Like I have another friend who was denied they got the NOIR and a very thorough laundry list of why they were denied all things they can prove and show evidence of. Unfortunately there's was a case of a real bad lawyer and showing nothing at initial petition. (Sorry I digress).

Just weird how some are asked for evidence and others get reaffirmed 2nd interviewed scheduled but not asked for anything and get a smile and wave u r approved.

Just a hot mess.

Gosh I just want my AOS to get invoiced. ;)

(6) Withdrawal . An applicant or petitioner may withdraw an application or petition at any time until a decision is issued by USCIS or, in the case of an approved petition, until the person is admitted or granted adjustment or change of status, based on the petition.
However, a withdrawal may not be retracted.

I know that the topic happened 2012. Any updates on this?

This is what happened to me also. Petition was scheduled for interview and then i sent US EMbassy Manila to withdraw the petition because of mistress issue.

But then i just realized i was not there maybe that is why there is a mistress so i want to proceed with the petition.

Did they consider your request to revoke withdrawal?

I sent them letter again to reconsider my request no answer yet

According to post 22 above you cannot retract a withdrawal.
