Can you revoke a withdrawal??? HELP my friend

Well its a different situation case was denied reaffirmed sitting at embassy letter has caught up with case and now a hot mess (I sear not me).

so can a withdrawal be revoked if so how who to call?

Once the petitioner withdrawls support for a case it can be closed. Could it be reopened, maybe but it is not normal and would only be reopened for special reasons. Lagos will probably NOT because it would be seen as a sign that the relationship isn't solid. Even if "you" could get it re opened Lagos will most certainly deny for lack of bonafide

Interesting yes it is Lagos but no support pull.

A case waiting for 2nd interview after reaffirm. Well the letter written months ago stating marriage is not a "bonafide marriage" oh boy has caught up to NVC and they are requesting case sent back to USCIS.

So what can they do if anything? Wrote a letter to revoke?

Of course how the heck would that 2nd interview go huh? Goodness

Okay before I start, this is not about me or my husband I swear.

It really is someone else who is not on VJ and to ashamed to post so I am doing it for them.

Here we go: what can you do if you wrote a letter to withdraw your case based on "I believe my marriage to be fraud and not a "bonafide marriage"? But now you have changed your mind?

Can you withdraw a withdraw? Or is that revoke a withdrawal?

1. Backstory as I was told: case is at embassy after a reaffirm.

2. Letter was written to USCIS. And I guess they forwarded to NVC who has requested case be sent back to USCIS for further processing.

This has all happened in the last week. I assume case is still sitting at Embassy.

I suggested to her (Petitioner) to call NVC first thing monday to see what if anything can be done.

Call congressmen/Senator also on monday.

I know this is well out of the ordinary but I know somewhere someone wrote a letter to withdraw and change mind.

So any advice, direction would be appreciated.

I don't think you can withdraw a withdrawl but won't hurt to try. The issue will be HUGE questions about the relationship. If someone wrote a letter stating they think their partner is attempting to obtain a green card by fraud and then changed their mind...well hmmmm. Are they by any chance from Nigeria? If so this will make it almost impossible to pass the interview.

My best advice, hard as it is to hear, would be to simply withdraw the petition and wait about a year before re-filing. Of course send a letter explaining. This will give everyone time to obtain some assurance the relationship is real.

I was thinking the same thing for them. Like if it was accepted the interview (yes in Nigeria) would be ummm hell on earth I would think.

I mean it would go like this "so ur wife claims your marriage isn't bonafide. Why would she say such a thing and wrote a letter to stop this process?" Goodness

Also can you even refile a I-130? Remember its at the reaffirm stage 2nd interview.

So if they refiled you have the denial issue to overcome and than this letter to overcome, than dealing with the most difficult embassy on earth. My head hurts. WOW

No details just a I want to pull my petition my marriage isn't a Bonafide marriage. That's it no - been scammed (which is was not) or fraud (which it is not) just a hot headed moment she had and allowed emotions to take over.

And as for time spent together, unfortunately not much time spent over 2 years about 3 weeks.

So do they then just have to refile again at some point? Can u do that with a I-130? Or do you request the current I-130 to be reopened?

Have they received notice it has been closed? They would most likely have to refile which yes, they can do. But the burden of proof in showing they have a bonafide marriage is going to be extraordinary.

I would think the same thing. That they will have to prove beyond a shadow of a doubt that this relationship is real. She did state that the marriage wasn't bona fide. It will be interesting to see what comes of this, whether or not she can revoke. Given other threads I have seen, they seem to all concur that you cannot revoke a withdrawal.
