Hi,

On I-864, I'm not sure how to answer question #25 on Federal Income Tax Return Information. My income is enough to sponsor my parents without adding my spouse as a sponsor. But the form asks for "my total income as reported on my Federal tax returns for the most recent three years" and I filed joint tax returns for each of those years with my spouse. Does that mean I should put what our joint tax returns say for our adjusted gross income (which includes his income and mine) or should I calculate what my own AGI would be without his income, since I'm the only sponsor for the affidavit? Or is it better to add my spouse as an additional sponsor as well?

For the 2nd and 3rd most recent tax returns, my income alone does not meet the poverty guidelines for sponsorship. Is this a problem, or do they only care about my current income and current year's tax return?

If you filed jointly you can either submit your W2's to show your individual income or contact the IRS for your transcripts

The requirement for the I864 is the most recent tax return. Send it along with the relevant attachments, which include your W-2.

Count yourself, your spouse, any dependants claimed on the return, the person or people you are sponsoring in household size.

If your income alone covers the required amount your W-2 attached to the filing will susbstantiate your affidavit. If your spouses income is needed have them complete form I864A.
