Get in contact with the embassy!

They are able to help and normally will do so.

Tell them what happened and that you decided to move back to US because ...

You are still in a time frame where your green card is ok, but the longer you wait the more difficult it gets and the less options you have.

I doubt the embassy can or will do anything to help her because she abandoned her residence.

It certainly does not hurt to ask, however.

Thank you everyone for the continued thoughts, my apologies, I've been snowed under at work and I have a 7 month old to tend when I get home :).

As I said in my second post though I do have commitments I made on coming here that mean I will be here past the 12 months anyhow, I'm still hoping beyond hope that hubby changes his mind too as well.

I have my appt booked for getting the kid registered and his passport for later in September so I will endeavour to speak to someone while I am there but every single thing I have ever read about abandoned PR's being let back in required some form of oops to have taken place and a home there to return to. We do not have one and will be starting from scratch again.

The support affidavit is going to be a pain in the ####### but that's something we will just have to deal with, if he can get his old job back then it won't be an issue.

02 Dec 2011: Moved back to UK. Intentions permanent. Permanent residency abandoned.

27 Oct 2012: Hubby homesick, I-130 sent.

30 Oct 2012: Signed for at Embassy

06 Nov 2012: I-130 Returned, USA Card Declined due to Fraud Alert despite letting them know first.

10 Nov 2012: I-130 Resent.

17 Nov 2012: I-130 Returned, UK Card Declined - probably the same reason.

20 Nov 2012: I-130 sent with bankers draft

26 Nov 2012: NOA1 Received - Finally...

13 Dec 2012: NOA2 Approval Date
