OK, so when hubby filled out I.129F he included both my kids on the form even though they were NOT accompanying me to the U.S.

When he called DOS on friday he was told that the application forms for my 2 sons hadnt been received yet! He explained to them that they are not coming to the US and only included them because we got into trouble with immigration. They advised us to write a letter to the embassy stating this, and to ask them to amend the K-3 application and remove their names from it. Could they tell us that we will need to re-file all over again for K-3 or will they amend the application seeing it has been in London since early september.

On the DS-156K i checked the boxes NO for accompaying me to the US and NO to follow me later.

From this will they know that both my teenage sons are NOT coming to the US with me?? and if so why are they delaying the interview based on what was on the I.129F??

Is that whats delaying my visa interview at the embassy??

and only included them because we got into trouble with immigration. OOPs this should read: and only included them because we thought we would get into trouble with immigration!!!

Any help would be appreciated.

Hehe, was just like that: so how could they from that info think that they were coming with me. It doesnt state if said children were accompanying me to the US. Just to list all children LOL

I don't think its at all unusual for it to take a month or more for the consulate to schedule your interview and send out the letter.

Its probably nothing more than that. If they're not accompanying you, and if USCIS was confused about that, they'd have sent an RFE during the I-129F, they wouldn't have approved it.

Why do you think your interview has been delayed?

Basically coz DoS told hubby that the embassy has received and processed my forms, but they were waiting for K-4 forms for my 2 sons, who were never going to the US to begin with, DoS advised my hubby that i should write a letter to the embassy stating that my kids were remaining in the Uk with their father.

I guess my more accurate question would be: what makes you think that your interview *has* been delayed at all?

You appear to be right on schedule still. The kids thing will work itself out. I suppose I am sceptical aboiut the info that DOS gave your husband.

All children should be listed in the petition, even if they will not be immigrating now or in the future.
