Hi guys,

I need help about my k-1 fiancee visa, i dont know if im in the right section and maybe all my questions are been answered already.

I am confused about what form i need to use for using a co sponsor. i read some article that it says u can use i-134 for co-sponsor? i know i-864 can be use when changing ur fiances status when she gets here in USA. For my 2009-2011 IRS, i am under the annual income requirements, around 9k-14k annually. But for 2012, i am making more money maybe around 16-19k. im not really sure. I live with my mom and i got a house and a car but it didnt have my name on it since i dont have a credit before when we purchased it. So im just a co-own on both my house and the car. Even savings in my bank, me and mom are partners. but i made another savings account for me. My fiance lives in the Philippines and i heard we cant use i-864. But some people brought 2 forms the i-134 and i-864 and they got accepted. I am planning to do the same but is there any other way to get approved? higher chance i mean!!!... if not, can i use i-134 to use for co sponsor and let my mom sign the form? will that help? My fiance is a nurse and she left her job since she cant get off from work if she prepares all this documents. Her being a nurse, can that help? because if u think, once we get married and change her status, i think she will make more money than i do. Or i could work for another part time job maybe mcdonalds if does helps.

I will be doing the I-134 both from my fiance and his mom and have the I-864 from his mom on reserve. My interview is on the 28th.. I have been stressed about this but then I realized we can only do so much about this. All I will do and prepare is provide everything that we have to prove that our case is possible and that I will never become a public charge. It all depends on the consul so good luck to us!

The Embassy cannot accept the I-864 for a K1, this is in the regulations of the FAM. Just do I-134 for yourself and from any sponsor you wish to offer.

Being a nurse doesn't really help on a K1 because your fiancee cannot legally work until she adjusts status. Consuls adjudicate on the current sustained income not possible work they can possibly get after they possibly marry and possibly adjust status.

You said for this year you are making more money right? Around December you might get your NOA2 and from then you can prepare the requirements for interview, and by that time I think you'll have enough sustained income that can meet the poverty guideline so I think you have nothing to worry about, you wont even be needing a co sponsor if you keep your job right now and keep your pay stubs.

i see..about my work,i got lil problem. I work at the Airline, this coming sept, we have a transition(i mean another company gonna take over our station). I know im gonna make a less of money because its like starting over from a new job. If we continued our current pay, im sure ill get the annual income but i dont think so this time. So u think ill get two job statement from Jan- Sept and Oct- Dec right??i heard its more important if u make more money going forward even ur previous IRS (09-11) are low than having a good previous yr then jobless or ur making less money in the current year.

Oh,i sent my NOA on June 8 not July :P...im hoping i can get my notice next month..LOL...

You better not hoping too much, that's not realistic. VSC is very slow right now, so try not to expect your NOA2 before 5 months from your NOA1 date. BTW, you didn't "sent" your NOA1, that's something you received from the USCIS.

Following up from didopage,

This is the statement from your timeline about your possible I-197 (NOA2) visa petition approval:

"Based on timeline data, your I129f may be adjudicated between December 5, 2012 and December 10, 2012*. "

Good luck on your visa journey.
