So the correct address to send in the I-485, I-765, G-325A and I-864 is:

The PROBLEM with our case is this... We are about to file for AOS and both I and my wife's co-sponsor are unemployed. All of us moved in the last two months to NC and nobody has a job yet. My parents (mom is the co-sponsor) bought themselves this 400 grand of a house and own 90% of it. They have cash in the bank and stocks and bonds, but mom has not found work yet. Likely she will be working by November, but we simply cannot delay sending the paperwork anymore.

I'm here in a small little place, rent free, with the wife and we will be here for a while. No job yet. It's been murder. Just lots of bad luck.

So in the cover letter I am careful to describe the situation and point out that it is temporary, that both I and the co-sponsor will have jobs by the time of the interview, etc. etc.

So if this going to be an issue? What do you think?

I am betting we will get letters requesting more evidence.

Will this delay my wife's employment authorization? She is getting really angry that she cannot work.

Awwww...I can't offer any advice about how the unemployment issue will affect any decisions made by the powers that be but I really hope things pick up for you SOONER rather than later. I can't imagine the stress of being unemployed. My heart goes out to you both (F)

The address you have for the Chicago Lockbox is correct ...

Unfortunately I don't know if an RFE for I-864 would delay your wife's employement authorization ... If you case makes it through the first review at MSC then is forwarded to either your local office or CSC then I would think that her EAD wouldn't be affected but if it is caught prior, then I believe it could possibly delay it ... But I am not sure ...

I don't really know the answer but no one had responded to your post yet so I thought I would get the ball rolling ... And if I give you the wrong information I am pretty sure many people will let me know :)

You mentioned that your parents had stocks, bonds, etc. I believe they can consider these as assets, so as long as what they have exceeds the poverty guidelines, I don't see why you should have problems. Another thing is it takes time to process AOS, so by the time you have your interview, you probably will have new job and so will Anh, and you can use your new income to make new affidavit. You can even use Anh's income if she's worked for over 6 mths at the interview time. I know the officer that interviewed us asked for new tax return as it's been over a year since we filed it.

I don't think the co-sponsor situation will affect Anh's EAD. And she can always go to the local DO and get temporary one if she hasn't heard anything after 90 days.

An RFE on the AOS petition will indeed slow down the EAD.

Local DO's no longer issue temp EADS.

Stocks, bonds and other assets can be used in lieu of wages earned through conventional employment. They must be three times the amount of the shortfall, which in this case sounds like the entire amount. Conservatively I would prepare such an affidavit with as much information about the sponsor's total asset picture in order to make it as 'solid' as possible.

The last years income tax return is all that is required to substantiate income. Whether or not you roll the dice by stating that someones employment picture is changed since that return, and will improve by the new one, is a calculated gamble.

You can use assets, read carefully about their instructions. If your mother owns enough you won't get a RFE, but anyway, as soon as you have a job you will have to notify USCIS about the change.

You can send off the AOS anyway, so the process will be started. And yes, RFEs for the affidavit of support put the EAD on hold. In my RFE letter it said: you are ineligible for EAD until 90 days after we received your answer (of RFE). Anyway this was not the case because I received my EAD after 80 days from our filing date, but I am sure that they put some kind of hold on it.

If you send in incomplete or insufficient I-864s, they will be returned via an RFE and the Service is under no obligation to meet any EAD deadline, perceived or otherwise. The AOS will not be 'accepted' (and so will do nothing for her status) if a portion is incomplete.

Reports here are that the RFE for I-864 does indeed halt processing on the EAD *because* the I-485 has not yet been accepted, and there is no status to hang the EAD on.

Your mother could complete her I-864 based on assets, by the look of it.

Your wife should not be 'angry' that she can not work. This period of unemployment is a well known condition of the K-1 visa. I hope she can move out of her disappointment to some peace of mind.

I cannot control her boredom at not being able to work. She just doesn't understand. :(

I mailed in everything today and hopefully the family assets will make the case happen, but I expect an RFE. I have an interview tomorrow and it looks good, but the wages are sh!t and it is part time. So below poverty level. Hopefully between myself and mom we'll be OK soon and can send in an update.
