Hey everyone! I am kind of new here but just wanted to post my first topic on something that confuses me. My husband and I filed his petition for the I130 here in Nairobi Kenya and it was approved. NOw we are getting everything ready for his visa interview and i was wondering. Since I am here in Kenya with him until we get his visa (I didn't want to leave him) Is the visa application filed and kept here or do we still have to wait for them to send our info to the NVC in America. I also have a co-sponsor who is still residing in the US. Anybody know how it works? s it different if filed here with the Us citizen spouse or do we still have to wait for the NVC? We got our case number pretty quickly and we should have an interview pretty soon as well. Thanks.

Once your I-130 is approved all cases get sent to NVC. You say you have a case number, have you receievd the Invoice number? You need both in order to pay the IV and AOS fees online in order to proceed. Both AOS and IV packets get sent to NVC, regardless if petitioner is overseas. The only exception is if you are doing DCF (Direct Consular Filing). I am the petitioner and sent my paperwork to NVC from Argentina, does take a little longer:)

Moving from IR-1/CR-1 Process & Procedures to DCF Discussion; OP's information and first part of their post indicate this is how they filed.

OP, if I am reading your information and post correctly, the petition was filed at the USCIS field office in Nairobi. If that is the case, then your file will not be sent to the NVC and any references to the NVC will not be applicable to your case.

Yes we did file in Nairobi so does that mean we will just have our whole process done here in Nairobi? I mean will teh office here in Nairobi give us a visa number? Thanks so much for your response.

If you have done direct consulate filing (which is what it sounds like) you will not have any interaction with NVC and your case will be kept in Nairobi, there is no forwarding of papers back and forth between the US and the other country. This means the process is quicker. What should happen is that you will get a case number and a visa packet (which is also on the embassy webpage:

Usually whatever is sent in the mail is almost the same as what is on the webpage but of course someone who has filed there can tell you better. If you want to start working on something you can fill out the DS-230 and I-864 if you have not yet received your packet. Usually police clearance and medical exams require some type of interview letter from the embassy. Your cosponsor will also have to fill out an I-864 and you will need a copy of that with an original signature so keep that in mind as it will take a bit of time to courier it to you. I suggest you not have the stuff couriered over until the last stage of the process because otherwise sometimes the poor person in the US gets stuck sending more than one packet.Your cosponsor/joint sponsor will need to send proof of citizenship as well so either a copy of their passport or birth certificate and photo ID (like drivers license), so be sure they know about that. It can take a while for people to get their hands on their birth certificate if they don't have a passport. Best wishes.

Thank you for the information that was really helpful! What if my cosponsors do not have a birth certificate can we use the drivers license work? Or should we wait for them to get there birth certificates? WE are done with the medical and everything but if we have to wait for the paperwork i don't know how long the embassy will wait. Will they wait for as long as we need to get all the paperwork? I know these are silly questions but iw ant to make sure i have everything right you know?

Birth certificates or passport. These are used to show proof of US citizenship. So no drivers license. Sorry
