I am so mad todayI I married to my husband now 3 years we are together for 4 years ! I didn't even file for him to come to the USA until we where married 3 years! W e lived together in Cairo Egypt all this time. I filed the I 130 back in December and the process has gone really quickly up till now! I had to come home because I have multiple sclerosis and take injection everyday and was out of my medicine so I came home to the USA thinking it would be best to stay here and get things ready for us to start our life here thinking it won't be a long wait but it has been 5 months already.

He went for his interview just on Tuesday I thought this would be over but it's not! The man in the interview was giving him a hard time and was asking him for another copy of the co sponsor taxes info I thought that might be it that's all they wanted but now I get an email back from them saying also his case is under review I am assuming this review is because they are questioning our marriage witch is so crazy since we are married for such a long time! Really what could this review be for? what steps can I take for him to take his visa now? should I get my congressman involved ? does this review take a long time ? can he be denied a visa? I f I have to I will go back but it would be difficult , should I have the doctor write another letter stating how this has taken a toll on health? PLEASE any help is appreciated ! Rebekah

First, 5 months from filing to interview is almost 'record short'! Ok, so, did your husband show the co-sponsor taxes? Probably they are reviewing finances. Now, what makes you think they're questioning your marriage? I think there's more to this interview (i.e. the CO was giving him a hard time). I think the key is there. Go through the questions and answers. You also state that you had your doctor write a letter about your health. Is the doctor in the US or Cairo?

And to answer bluntly, yes, he can be denied a visa.

Don't ever do anything you're not willing to explain the paramedics.

I don't think they are questioning your marriage, I think they put you in AP, which is pretty much a requriement for MENA countries. They are doing background checks on your husband. But the answer is yes, the visa can be denied if CO is not satisfied. Unfortunately there is no timeline for AP it could take from as fast as several weeks to as long as several years.

I forgot about this! AP- that's probably it: name checks and background checks.

it wasn't 5 months it was 9 months from start to finish , witch is still very short , the co sponsors taxes he is requesting 2012 as he wanted this years as well that's no big deal I can send them, he kept asking him the same question again and again " where did you meet your wife" the doctor is in the USA . thank you for your imput I think I must go back to Egypt and stop waiting here for something that might never happen.

I forgot about this! AP- that's probably it: name checks and background checks.

I think this will take a very long time ..uhh am just going to go back and be with my husband ..

whats MENA? this background check I thought it was done before? you all are making it pretty clear that staying here is not an option at this time .

MENA= Middle East North Africa.

They are very meticulous as males from this region have a notorious reputation of committing immigration fraud; Egypt is in the top 5. AP is to make sure they are not a threat to our national security. It may take 3 weeks to years- in extreme cases. Now, when they say more review (which is not necessarily, but does not exclude AP) they may mean they want to check finances and a bonafide relationship. In extreme cases, a surprise home visit may occur.

So, my suspicion is they may not believe him... you're right. If the CO kept on asking over and over again "where did you meet your wife?" your husband might've raised a red flag with a dubious answer.

Here are the red flags:

age difference (female older than male)?

same religion or female converted for her spouse/ fiance?

previous marriages and/or kids?

How the couple met? So, if you were introduced by his family member, it may seems as someone is playing matchmaker to bring him to the US, for example.

Language barriers?

Finances?

If any of these questions came up, find out what and how your husband answered. The clue is there. You don't have to run off to Cairo just yet. Maybe the review takes only a week. My advice is to follow up and then make an informed decision. You've alraedy spent 9 months in this process. You can wait a little longer....

If he answered he met you 'by accident through friends' that's a huge red flag as it is somewhat an oxymoron. Was it by accident/ chance or were you introduced by common friends?

Your health, I don't think, is an issue- that is unless you're age gap is overwhelming, say he's 25 and you're 65... for example. There again, the age gap is a red flag on its own.

Finances: you said you have a co-sponsor. Wait and see what they say. Congressman at this point is useless.

If he answered he met you 'by accident through friends' that's a huge red flag as it is somewhat an oxymoron. Was it by accident/ chance or were you introduced by common friends?

Your health, I don't think, is an issue- that is unless you're age gap is overwhelming, say he's 25 and you're 65... for example. There again, the age gap is a red flag on its own.

Finances: you said you have a co-sponsor. Wait and see what they say. Congressman at this point is useless.

no he told them the truth we met when I was introduced to him and was hanging out with him and a whole group of friends we where friend for a long time before we dated we would all go out together ..after sumtime we dated after a year we married . I don't see how this would be a problem maybe it's me being paranoid and they just want to tax papers he didn't give him his passport back he asked him if he wanted it my husband said no ..

I thought maybe bacause he asked him how we talk to each other I honestly can understand my husband and correct him when he doesn't speak right not that the average person might not understand him ..

the problem is I have so many things on hold I am staying with my mother and cannot possibly stay here anymore it is to hard I want to get a house and a car but if this is going to take a long time than I want to go back with my husband I really am ay odds if I use that money and than after a few weeks he can come than I don't have the money to get the car because I used it on my ticket I think there is no way they will tell me either . I guess I have to see whats the best thing to do at this point . thank you Rebekah
