Timeline

I had my biometrics appointment yesterday and now on Saturday we may move to our new apartment. So far we've been living with my in-laws and it's not far at all from the new place. Anyways, I wanted to know if we should notify them about the new address or just leave it with the one we filed with (my in-laws' address). The reason why I'm asking is that I heard there can be a delay and it's risky to change e address during AOS. Thank you very much!

*We are in the middle of AOS from K1. Moving from Dallas, TX to Lewisville, TX.

If this is going to be your new, permanent address then change the address using an AR-11 within 10 days of moving. It's a legal requirement that you keep USCIS apprised of your address at all times.

If they ever found out that you did not live at an address which you stated you did live at, you could incur significant issues for yourself down the line.

Best to head those off now by filing the AR-11.

Online is fine, just make sure to change both your "normal" address and also your address for all of your pending cases (they will prompt you to do this).

Print out a copy for your records so you can prove down the line that this was done.

If your wife has filed an I-864 then yes, she will have to file an I-865 (change of address for a sponsor): http://www.uscis.gov/i-865

Just make sure that you also file an official change of address with USPS! You can do it online or fill out a form at your local post office. This will ensure that any notices from the USCIS will be forwarded to your new address. They won't forward the actual green card (they will return it to USCIS) but they will forward notices. To ensure that you receive your green card at the right address, just submit the AR-11 online once you move AND call USCIS to verify that they changed it.

Once the AOS is approved yes, she will need to file an I-865. Since your in-laws are so close, just do the two steps for the on-line change of address (since you have a pending application) and if the USCIS delivers something to the old address just make certain you still receive mail there and go and pick it up. Not a real problem. The problem is when you have a pending application and move and the USCIS does not get teh address change and still sends things to the old address and you have no way of receiving that mail--you do.

We haven't moved yet but we have up to the tenth day after moving in to file the change of address, right? I mean, the move-in date on the lease is the beginning of August but we haven't gotten around to move yet. I'm on the right way notifying them after the actual moving date (not the one on the lease), right?

YES, you should file the AR-11 within 10 days after you actually moved to the new address :)

Also, don't forget about changing your address with USPS before you move (you'll be able to set the effective date for them to start forwarding your mail to your new address)!

You can do it online at https://moversguide....?execution=e1s1 (there's a $1 charge) OR you can do it by filling out a form at your local post office for FREE :)

They will send a confirmation letter to your new address within a few days which will serve as proof that you changed your address properly if USCIS happens to send stuff to your old address in error even after you submit your AR-11 ;)

Do NOT file a forward request with the USPS as they will NOT forward anything from the USCIS but sent it back to them. Since the old address is close and you have relatives there, just make certain you can get mail at both addresses until the AOS is complete and you have the GC. USCIS sometimes does not get the address updated in a timely manor and items are mailed to the old address. As long as you have e-mail or text notification enabled, you will get an e-maill and text of the fact theitem was returned by the USPS and then you have to call them and get it redelivered to the new address. If you did not have relatives at the old address I would recommend putting a 30 day vacation hold on the mail at your old address and pick it up at about day 28.
