A few questions about slowing down k1 application.

Hello vjers,

Ok I'll be as concise as possible.

Our NOA2 has come way quicker than we anticipated (66 days) which has caused a bit of panic.

I am starting the process of ordering my police certificate from Bahrain in a few days when I get back to the UK. This can take 3-4 months, and is a real pain in the butt.

1. Who gives out the initial interview date or do we get to choose?

2. How flexible is London on postponing interviews in order for beneficiaries to get their documents together?

3. Our noa1 date is June 11 2012. When is the latest we can schedule an interview? Does our NOA2 expire?

Everything is happening so fast - I just need to know that London will allow us the time we need to get this certificate.

Any ideas?

Hi Claire,

It's great that your NOA2 came early but I can see how it has caused a bit of a panic. Police records do take long to acquire!

1. What I got to do is select the week I wanted my interview to be. Of course, you'd want to make sure that your interview is before the petition expires. Once I put in my request, the Embassy got back to me with a time. This, I was unable to change. If I had to, I think I would have had to request a different date.

2. If you want an extension for your I-129F, do it soon. The sooner the better, I believe. If you already know that your police record is going to take 3-4 months and are concerned that you won't have enough time to get your interview and medical exam done before the petition expires, put in the request for extension. I didn't do this so I can't say how willing or easy or hard it is but on the form the Embassy sent me, it sounded like it's totally okay to request an extension.

3. I had an expiration date on my NOA2. There's a line that says, "Valid from XXXX to XXXX." If you think you can't complete the whole process by the expiration date, yes, request the extension.

Congrats on the fast action!! Okay now your case will be sent to NVC which can take 20-30 days to get your case number. Once that happens than you will be sent requests for fees and have to do your financial packet and final packet that will be sent to the embassy so that can be another 30-60 days+ depending on how fast you can pay fees and get all your

information in and all approved. Once all that is done than your case is forwarded to the embassy and an appointment is made by NVC. So you have a bit of time to work with where in which you might get your certificate in time. Something to think about! Best wishes!

Sounds like I can buy some time at least. I can always complete the packet slowly, at my pace to give me more time! I mean I'm not desperate to be over here - just spent all summer with him I need a break, ha! Think he does too... I will see what the expiry date on our noa2 says and in the mean time get my stuff ordered for Bahrain. If push comes to shove I can make a trip to Bahrain to get it in person, but it's not the sunny party island it used to be anymore! Thanks!

Thanks Vicomi! I'm just gonna let NVC do as they wish to it now, I honestly had a feeling this was coming I even downloaded all the DS forms today. And voila, 8pm exactly a text came....

This is not the procedure for a K1. The file can be in and out of the NVC in 3-4 days. Nothing is mailed or paid to NVC and they do not scheduled K1 interviews.

The embassy assigns a date. You can request a delay if it's not going to work for you.

They won't even give out an interview until you return the DS-2001 form that says you have all your documents in hand.

3. Our noa1 date is June 11 2012. When is the latest we can schedule an interview? Does our NOA2 expire?

NOA2 will expire around mid December. You can be slow turning in your forms to the embassy. Don't rush like most try to do to mail them before London even contacts you. Wait 2-3 weeks after you get the letter from London. Mail the DS forms, but not the DS-2001 readiness form. If you don't have what you need by early Nov, then write a letter to the same address where the forms are mailed saying you are still very much pursuing a K1 visa, but have been waiting on [fill in the blanks]. That lets them know you didn't abandon. Repeat if you dont have Bahrain by Dec 1, but also adding a request that theI-129f petition approved on your behalf be extended another 4 months.

Once you have the police certificate, then fill out the DS2001 form and send it. Include a cover letter with the info they request in their instructions, as well as stick in a blurb about still actively seeking a K1 visa. Then wait for an interview date. You will need another letter of intent (new one) from your fiancé saying he is still free to marry and intends to marry.......etc. Get it notarized just because that's what the London letter says about extending the petition. I think it would be okay without the notary, but follow their instructions.

Oh yeah---get a medical exam sometime in there...maybe October, so things trickle in and they can see you are working on it.

Thank you so much that has cleared everything up for us. One more, when is best to request an extension - is there a specific form I need to submit or can I just send London a letter explaining my situation?

There is no form. A letter with all your details and case number of course. Do it before the expiration date--maybe 3 weeks??. The NOA2 will have that date printed on it, as will your letter from London. It's four months after approval. I would probably also include a letter from the USC fiancé saying he is still on board when you write the request just so they know. I know others who have stalled and didn't keep them informed but just trickled things in. Supposedly as long as they get things from you like the application, then medical results, your petition will be extended automatically. However informing them formally is a good measure to take so they know you are dealing with a hard to get foreign police report.

The official word from the embassy contained in the letter is:

The K1/3 petition is valid for four months from the date of action (priority date at the bottom of the letter) and must be valid to process your case to conclusion. To revalidate the petition, please request your fiancé(e) to make a notarized statement of intent to marry within ninety days of your arrival in the U.S. and present it on the day of your interview

How long did you live in Bahrain? That can make it much more likely you will get AP for additional security checks after the interview. You may not get the visa approved for weeks or many months. Just a heads up so you don't make plans until the visa is in hand, even if they say "approved" at the interview.
