Question on filing my 3 years tax returns, I have copies of my tax return prepared my my accountant, but they are copies. Does the embassy require certified transcripts, or is copies of my original tax returns enough?

11/10/06 - Married in Ukraine

11/14/06 - I-130 Petition filed and approved

12/08/06 - First interview - we cancelled - shot ourselves in the foot for this!!!!

01/23/07 - 2nd Interview was cancelled due to Adam Walsh Act

02/13/07 - Sonya recieved her 5 year B-2 Tourist Visa

02/21/07 - Sonya arrives in America

02/26/07 - We are told of new interview on 3/8, but she is in america

03/08/07 - Cancelled interview, Sonya is in America

04/16/07 - Fly back to Ukraine

04/25/07 - FINALLY!!!! LOL Interview and VISA approved!!!

04/27/07 - VISA delay due to Sonya's name misspelling - Embassy typo in database

05/02/07 - Called DOS Washington - name check cleared for Sonya - but

told us no VISA was approved for daughter

05/03/07 - Embassy says VISA printed 5/2, but we caught that they forgot VISA for daughter

and the courier entered wrong address to mail VISA - SO MANY TYPO's & MISTAKES :(

05/08/07 - VISA YEAH!!!! FINALLY!

05/23/07 - Back to America - Well almost - Airlines messed up and sent daughters ticket to Chicago

05/30/07 - They finally made it!!! :)

07/03/07 - Green cards recieved

07/06/07 - Applied for SS card at local office, DS-230 application lost

2/19/2010 - Everything is great!!! We now live in South Carolina - Sonya has applied for her citizenship!! She attends USC for her BSN. Her mother has made 3 trips to US.

The information on the website does not say "certified" tax returns.

Answered same question last night.

The instructions are a bit out dated, the rules regarding the new I-864 form states Tax Transcripts are acceptable as well as copies if the tax returns.

And one more question, do I need the transcripts if I have copies if my tax returns from my accountant?

On the directions sheet I received it says I do need "certified copy of most recent feral income tax return".... :( I really hope this doesn't set us back!

I have copies of the original returns prepared by my accountant as well as the tax transcripts, from the IRS, again the instructions included with the I-864 form specify tax transcripts. By signing the I-864 you are certifing that the copies of the tax returns are true copies.

Section 213A(f)(6)(B ) of the Act gives discretion to alter the affidavit of support requirements so that a sponsor need only file a copy of the tax return from the most recent tax year, rather than the returns for the three most recent tax years. This final rule adopts this alternative. That is, once this final rule enters into force, a sponsor will only be required to submit one Federal tax return, for the most recent tax year. However, the sponsor may, at his or her option, submit the sponsor's or household member's Federal income tax returns for the three most recent years if the sponsor believes these additional tax returns may help to establish the sponsor's ability to maintain his or her household income at the applicable threshold set forth in Form I-864P, Poverty Guidelines.

Use of IRS Transcripts Instead of Copies of the Required Tax Returns

Another commenter asked whether the sponsor may submit IRS-generated transcripts of the returns. Under current IRS policy, IRS will provide transcripts, free of charge, if the sponsor files IRS Form 4506T. There is, by contrast, a fee for filing an IRS Form 4506, rather than the free IRS Form 4506T, if one wants to obtain an actual photocopy of the filed return. It is important to note that the interim rule did not require the sponsor to obtain photocopies of the sponsor's own returns from the IRS. If, as the IRS recommends, the sponsor has kept photocopies or duplicate originals of the sponsor's returns in the sponsor's own files, the sponsor may submit copies of his or her own file copies. Section 213A requires the submission of certified copies, but the interim rule and the Form I-864 itself make it clear that, by signing the Form I-864, the sponsor certifies under penalty of perjury that the copies are true copies. The final rule does give the sponsor, substitute sponsor, joint sponsor, household member, or intending immigrant the option of submitting either photocopies or IRS-generated transcripts of the required tax returns. Along with the transcripts or photocopies, the sponsor, joint sponsor, or household member must submit copies of all Forms W-2, Forms 1099, and schedules, as specified in the rule.

Thanks for reply, next part is all supporting documents such as bank statements, assets, liabilities. I earn far above poverty levels, am I required to show all these documents, or just returns?

If you far exceed the income level and you have good documentation I would not even go there....

Thanks, the I864 instructions list these documents, but I hear from many, not required as long as above poverty levels.

No, you are not required to show all these, since your income far exceeds the poverty level.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview
