PLEASE HELP!!STUPID NVC requesting forms we already submitted!RFE!

my husband submited his IV packet last week and it arrive on Friday and he sent in all the original forms but I just received and RFE!!!

They are saying that his birth certificate isn't original an it is the orignal one stamped and everything! Also he did request the correct police Certificate from Argentina! The one stating "with the exception to law 51" and I don't know what to do! I went over everything with him before he sent it and he did sent the correct form. I am so fustrated right now! please help

It would be highly unusual to have NVC actually review a package that fast. Often they send a checklist cover letter asking for something they don't know they already have. They would describe what they want. Does your RFE actually say they have a birth certificate and it's the wrong one, or does it just describe what they need.

We call these false RFE's but they really are just requests that cross in the mail because you used the shortcuts to send the package BEFORE it was requested.

This is a real RFE, not the false one I thought it might be. Is it possible your husband sent photocopies instead of the original documents you sent him?

I called today and the operator asked me where he got the documents from and as I explained she told me that it looks like I did turned in all the correct information. She then stated that she is going to pass it on to a supervisor to further review it and that it takes between 10-15 days. He submitted in all ORIGINAL DOCUMENTS.

What do they mean with the exception to art 51??. The certificate u need to submit from Ministerio de Justicia is this one http://www.gestoriaperegrinus.com.ar/certificado-de-antecedentes-penales.html

There, on the top part, it says something about art 51 del Codigo Penal. Must it say that or must not?

Did you have the Birth Certificate and Police Record legalized by the Ministerio de Relaciones Exteriores? If not that could be it. Also if the birth certificate was issued outside of Capital Federal, it must first be legalized by Ministerio de Relaciones Interiores.

Not sure what "con excepcion a la ley 51" means, dont really care, all I know is that it is required and needs to be requested specifically as so when the beneficiary goes to Registro de Antecedentes Penales. They knew exactly what we needed.

Many people have been delayed because of this and not legalizing docs.

We did both and had no problems and a quick NVC case closed.

Yes, the bottom of the Police Certificate will say "emitido con excepcion al codigo penal 51". Otherwise it will not be accepted.

When my husband went to get his police certificate, he asked to get it under that law while he got his finer prints "Este documento acredita que el certificado emitido lo es con excepción al artículo 51 del Código Penal, a

solicitud del propio interesado." that's exactly what it says

Yes, you are right, birth certificates and marriage certificates are emmited by Registro Civil of where the person was born/marries but they ALSO need to be then legalized at Ministerio de Relaciones Exteriores, another location.

Was he born in Capital or Provincia? If he was born in provincia, before Legalizing, it needs to go through Ministerio de Relaciones Interiores. I know its confusing but these details make all the difference between a smooth ride and stupid RFEs.

If he did not get additional original/certified documents, then at this point it would be faster to get new ones and legalize them. I asked for 3 of everything just in case.

OMG! I'm upset now! He was born in Buenos Aires, Capital Federal. Do you know where he has to go to get his birth and police certificate legalized?

I have no idea where " The Ministerio de Relaciones Exteriores" is located.

Wait. It is very confusing. Your saying he has to go to the Ministerio de Relaciones Interiores first and then to the Ministerio de Relaciones Exteriores? Two different locations? Why do they ask for so freaking much?! NVC AND ARGENTINA GET ON MY NERVES.

If he was born in Capital, no need to worry about Ministerio de Relaciones Interiores.

Just get another Police Certificate (Con excepcion a la ley 51 del codigo penal) and Birth Certificate and get them legalized.

Ministerio de Relaciones Exteriores is downtown, close to Retiro, Esmeralda 1212. Its pretty painless, check hours on line, anticipate up to 2 hours wait, they can do all your docs at once. Here is the web site.

In the meantime check out the Dept of State link I sent you on Argentina required docs. Might help you better understand these requirements.

Lol thanks so much for your help. You have no idea how happy I am right now. My husband has his original police certificate saved as a pdf form so he can just print it out and take it. Now his birth certificate he will have to request again or can he just take a copy of it and get it legalized? and lol argentina is overall complicated especially when i went to get my wedding certificate. ugh..but I love me some empanadas
