I'm the US citizen filing for an IR-2 for my wife and IR-2 for my son.

I've been living and working abroad for 6 years and I never realized that I would be responsible for filing tax returns on foreign-earned income. When it came to my attention during the visa process, I filed for 2007 - 2011 just 2 weeks ago.

My mother will be the co-sponsor, since I have no US income. But... the only proof of taxes I can show will be copies of the forms that I submitted. I just spoke to IRS and they have not yet posted the forms as received and I will not be able to get tax transcripts for at least 6 more weeks.

I know that copies of tax returns are accepted as it's stated in the I-864 instructions, but does that just mean copies from me or do they mean actual copies from IRS which cost $57?

Will I be okay with just my personal copies of my returns printed from my computer? Do they contact IRS to see if everything is in order?

Print your personal copies amd make sure it is signed.

While the I-84 instructions do specify the IRS generated transcripts as being required, several VJ members have been successful submitting copies of the complete tax returns for the most recent 3 years.

Worst case scenario is that you get an RFE for the transcripts.

BTW, transcripts are free.

Is your child eligible for US citizenship? If so, he cannot be issued a visa. A CRBA (Consular Report of Birth Abroad) would be needed in order to obtain a US passport for the child.

Transcripts are free, but the IRS brought my attention to the fact that copies of tax transcripts can actually mean certified transcripts. With that said, I just found this in ection 25 of the instructions for the I-864:

You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year.

Does USCIS contact IRS to confirm tax returns?

How are RFEs handled? Do you just need to mail the required info or do you need to hand it in person? Does an RFE significantly delay the visa process?

Look 5 paragraphs lower on page 8: If you were required to file a Federal income tax return during any of the previous three tax years but did not do so, you must file any and all late returns with IRS and attach an IRS-generated tax return transcript documenting your late filing before submitting the I-864 Affidavit of Support.

Well, that's conclusive. Thanks for pointing that out. I was actually going to schedule the interview for the first week of September. Looks like it will have to wait. Thanks again.

As I said earlier, other VJ members have been successful with photocopies rather than transcripts. Worst case is that you get a request for the transcripts. Might as well schedule sooner and perhaps the copies will be accepted. If not, you're waiting anyway but a few weeks have passed already so you are closer to the transcripts being available.
