Im trying to figure out if I am even eligible to apply for my husbands green card through DCF in Guatemala. Ive lived here 3.5 years but still only have a tourist visa (I dont work because my husband has a business) So would I be eligible even though I only have the tourist visa?

08/30/2016 Notified by email of APPROVAL of I-130

09/12/2016 Notified by email we can begin DS-260

(We are dragging our feet getting all paperwork done, little by little, because we are not sure when we will actually leave for the US)

01/12/2017 Completed DS-260, had to notify embassy that it was complete

01/17/2017 Notified by email we could schedule Interview at the embassy

03/06/2017 Medical Exam Completed in 1 long day

03/09/2017 Interview completed at Guatemala Embassy, Approved!

Guatemala does not have a USCIS field office so DCF there isn't possible for anyone. That being said, file your petition, be sure to have your US domicile and affidavit of support squared away, and let the games begin.

Peru also allows filing DCF while on a tourist visa. This is really a country-specific problem and we should be sure to recognize that in these cases.

Yeah, even though the Dept of State says you have to have a resident visa, I've seen plenty of countries let people file DCF without resident status. And all manner of other stuff. Mexico lets you file the day you get your resident visa, without the 6-month requirement that supposedly exists. Safest thing is always just to check with your embassy and see what they do! Glad to hear you might have a shot!

Long story short, we have a complicated case. We've been at this for nearly 5 years. You can read our story here. I highly recommend our attorney Laurel Scott, as well as attorneys Laura Fernandez and Lizz Cannon .

Filed I-130 via CSC in Feb 2008. Petition approved June 2008. Consular interview in Mexico, Oct 2008, visa denied, INA 212a6cii. We allege improper application of the law in this case.

2012, started over in Seoul: I-130 filed DCF on 7/2, I-130 approved 8/8, Medical at Yonsei Severance 11/20, IR1 appointment in November 2012.
