I was not aware one could file for returns that was not leglly here.. I however understood one could be forgiven for working and paying Uncle Sams money, too bad U took that atty bad advise to lie, all govt agencies share info when needs be, just pray things work out and explain things to immigration if U are asked.... be truthful

Yea you can get an ITIN from IRS which allows you to file a return. Since everyone legal or illegal is required to pay taxes. Yea i am very sad i did too. Hopefully i can work it out wheni make it to the interview stage. Thanks

Day66....10/11/12- Received 2nd and 3rd text notification about EAD card in production

Hi all,

Im new to VJ and i''m not sure that I'm even posting inthe right forum. But i have a dilemma and i would really like some help. I over stayed in the US and recently submitted my AOS package. While i have been here i worked the first year and filed taxes(with ITIN) as self-employed. Then i stopped working. Last August i worked with a family for about 5 months and didn't file taxes but when they did their taxes they declared payments for child care with my name and ITIN number listed on there 1040. My problem is when i filed my application on my form G 325a on the part where is says to list your last 5 employers i didn't disclose my work history. Is that going to be a problem. Will USCIS be able to see my employment history when they do the background check? Does the USCIS have access to IRS information in their background check

for filing tax there is a MINUMUM AMOUNT OF WAGE that you don't need to declare. but i'm not sure how much lol so if you make less than that minumum wage within that year...you'll be fine :thumbs:

The IRS and USCIS may not share information on their own, but once you send in papers and sign your name to them, you allow and authorize them to questions ANYONE ANYWHERE about ANYTHING regarding EVERYTHING. Your only possible saving grace is that you had legal representation and they informed you to take a different path which you now question. If I were you I'd send in an updated for ASAP, be sure to say it is updated or else they may see it as a different app. Explain why you think informing them of everything is the wiser ideas as you have here.

Better to go to them asking for forgiveness than for them to come to you. Good luck.

I agree with Harpa - bring a new form to your interview, tell them you made a mistake. If they ask why, tell them you got bad advice from a lawyer and realized your error and wanted to make it right.

An attorney was the one who told me to tell a little white lie as he called it. But I get what your saying. Just in case things get more complicated

Are you saying that a lawyer advised you to lie to the US government? If so, could there be any kind of malpractice? :blink:

Unauthorized employment is forgiven, but lying is not. Sorry, but liars and cheaters who try to get around the system we all had too suffer through get very little sympathy 'round here. Personally, I hope you get denied and deported.

I think this is a good advice :thumbs: Be honest to the USCIS during your interview and just hope and pray for the best. Good luck !

What happened to you ? I know it's been 5 years since your last post but it would be great to know what happened. Did you give USCIS the corrected G325a? I am guessing everything went all right since I saw other of your posts where you received US citizenship. Congrats!! :)

 

Did you get the Green card through marriage or diversity visa ?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
