Lied on form G325a

Thanks for the advice. I intend to tell the truth if they do ask. I wanted to send a corrected G325a but a few lawyers i spoke with advised against doing until they ask for it. They said i should leave it be until something is said since they may not even question it. I haven't heard anything from uscis as of yet since i just submitted my packet. Only the text notifications were sent to my spouse.

Was looking at your timeline and i see that you just got approved. Congratulations. I've had one problem after the next with this whole thing. First it was my missing I94 now it's this screw up. So frustrated

for anyone else: for heavens sake do not lie... ts very easy to prove the truth, very hard to prove what is not true and the penalty for lying is always worse than the penalty for what ur lying about.

My guess is that if you hear anything about it, it will be at the interview. Tax returns for the beneficiary are not required for AOS submission. They don't have a reason to go looking for them. And did you even put your ITIN anywhere on your forms?

Yes... as I went through training as an officer in the Army we had a whole block of instruction on ethical choices. And just using the defense "I was only following orders" is no way out. Each person is responsible for his or her ethical choices regardless of what being told to do.

I don't maybe a sticky should be made for this.

One can listen to lawyer but have to make a personal judegment about not disclosing the information or lieing on immigration form.

The outcome is not going to impact the lawyer, he has already made his money it is the applicant who is going to be impacted by the outcome.

Keep in mind that even if you got all the way to be a US citizen, you can have that stripped away from you if it was proven that you did a misrepresentation. I wouldn't chance it one bit. There is no waiver available for those with misrepresentation and you would be forced to live your life outside of the US permanently.

I would get a different lawyer because the one you have sounds incompetent.

She is not gonna lose her citizenship if she got it for such a reason, please you don't need to over react when you are not familiar with the immigration law. I advice you to go over the cases which the Federal judge dropped the citizenship.

Ok, but it's already done. She can't change it now. Now she has to wait and make the best of whatever happens.

I don't think this misrepresentation is material, because illegal employment is forgiven for spouses of USCs. This illegal work will NOT decide the difference between denial and approval. Why on earth a lawyer advised to lie when telling the truth would have zero negative effect is beyond me...

If I were you, I would complete a new G-325A and have it ready to present at interview. You can say "I made an error on my form and wanted to hand in a new one" and see what happens.

I already figured that out. Guess i just have to wait and see how this plays out.

So they don't have any way to really look you up unless they're intent on tracking you down by name.

What could happen is that they will look at how long you've been here and say "are you sure you never worked?" That's the time to tell them "yes, actually I did work in 2010 (or whatever.)"

Don't panic, what's done is done. Your story serves as a lesson for anyone else, so thank you for sharing it. This process is stressful enough without these added concerns.

Now, it's time to hope for the best, cross your fingers, pray (if that's your thing) and wait it out.

My advice is go to the interview and give the officer a new form, and be prepared to answer about your previous work. but, be confident , this is forgiven by law, is not the IO choice: if you are satisfying the conditions for AOS- marriage all your overstay and work issue will be forgiven. Plus, try to check with IRS if you owe them any money, which I don't think so

That's why i was kicking myself for doing it. Cause it wasn't only after i realised i'd read somewhere that they forgive unauthorized employment if you're an immediate relative. I already filled out a new G325a that i'm prepared to present if the time comes. Thanks again for the advise
