Lost old OPT paper work, should we both with EAD?

Darn, that both in the topic should be bother.

Anyway... while filling out the i 765, we ran into the question if she ever was given EAD before. We are assuming that the OPT she got while she was here on F1 Visa 5 years ago is like an EAD. She has lost her paperwork from that time. Incidentally she was granted OPT and worked for a year.

I was told by another forum member that maybe she should call her old school. Well she did.

Unfortunately the international student service office in her school claims to have no paper work for her OPT, meaning we have nothing to submit in evidence for her past EAD for the I 765.

Should we submit the EAD without her OPT paper work? Or would it be more wise to just skip the EAD to prevent a slow down of her AOS and getting her green card? I'm afraid they'll RFE us for that OPT. And once she gets a green card she can work right?

Since the questions specifically asks about and EAD, then you simply cannot 'skip' it. You must answer truthfully and then submit the paperwork you have.

I am sorry she lost it but if you get an RFE then you'll deal with it the, I hope you do not however.

Good luck

Hi,

I was actually more concerned about the i485 AOS; the i765 is optional right? And if I did submit the i765 without her OPT paperwork, we'd get an RFE for the whole process? That'd delay her AOS maybe?

I'm just so confused. If I could worry less that'd really help me out. I understand that her GC could take a while, but it's not required to submit the i765 with the AOS right and there for I could just hope she gets her AOS done quickly.
