Today my fiance had her interview for K1 visa and it wasn't approved because lack of photos of us together and lack of other evidence. She said the rest of the interview went well and she thinks it would have been approved if we just had more pictures of us together. I'm in the USAF and i was there for only about a month. We spent every day together while i was there but we just don't have lots of pictures. I'm at a lost now, i always had positive thoughts that it was going get approved. We don't call each other or email. We communicate almost every day for the past 2 years over skype and yahoo messenger. I'm not sure what we should do now to prove that we have a legitimate relationship. Anyone else been in this situation before or just anyone have any advice? I would like to be able to just provide the evidence they need and be done. I first filed the petition last september and it has been a long year of waiting and anticipation. Would it be better for me to go back and marry her in Thailand and reapply for a k-3?

did you include any of your skype/yahoo chat messages? That can be used as evidence as well, and if you have any letters/mail you sent each other, that can be included too.

If you are going to marry her you need to apply for an i 130 for a cr1 spouse visa....a k3 is obsolete and not used anymore(not sure why the USCIS still has it on their website). A k3 was used years ago to get a spouse here faster while awaiting the cr1,when the processing times for the cr1 took years. now a cr1 is processed in about 6-9 months or less start to finish. Make sure when you send in the i 130 you send supporting evidence like pictures, copies of boarding passes, copies of visa stamps, emails, chat records..etc...at the top of this page is a guide for you to follow when you file. Good luck.

visa not approved ?

what does that mean?

please tell us exactly what paperwork she was given, on interview day.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

The fact that the visa wasnt granted doesnt mean it was denied. She should have been given a document indicating the reason. It seems it was a lack of proof of your relationship beyond the inital visit. You should have some info in some form to supply to them from skype and Yahoo. Print off some of that and scan to her. She can take that to the embassy for review. If this is done they will allow her inside and tell her what they will do after that. Usuall they need a few days to a wek to do the review and then issue the visa a few days later. Hopefully she will be asked to leave her passport with them which will mean they want to grant the visa.

You could marry her at any time and file a C R 1 the next day.

If your girlfriend is from Korat, my fiancée called her the following day. Someone suggested sending the logs of all your Skype and Yahoo sessions. I had a ream of that type of evidence and many were just attempted calls without a connection but I sent many years worth. Yes, hopefully they just need more of this kind of documents. My question is whether or not a K-3 application starts anew the whole lengthy process or not? Best luck and hope to see you around Anchor town soon.

Photos photos photos!

This is what happened to me.

It took 3 tries to get the visa. She went in alone on Feb 23, 2009. They gave her 221g. They wanted more proof, and said that my I-864 was below the guidelines for 2007, since I owed the IRS 10k. I fixed the I-864 issue by sending my 2008 IRS returns with W-2s and 1099s which showed me to be well above the limit. I still haven't figured out how they found about this, or why NVC didn't deny me at that stage. Went back in March 2 with the updated tax returns and more proof. The accepted the tax return, but denied her again. We want to see more photos! Ok then 2 disposable cameras, photos together all over Bangkok, off to the 1 hour photo shop. Went back in AGAIN on March 3 with these photos. Visa approved, come back tomorrow to pick it up.

I lived with my wife in Bangkok for 2 years. I showed them utility bills with both our names, at the same address in Bangkok. I also showed them two passports with about 100 entry stamps into Thailand. I guess the issue was that I only proved to them that I lived in Thailand, not that I lived with her. So next time you are together, go crazy with the camera.

Agreed, photos, photos, photos and more photos!! My fiancee just had her interview on 8/28/12. The farang CO spent a lot of time going over the photos with her. He paid particular attention to the photos with family, doing sin sod with Khun Pa and Khun Ma, bar-b-queing with her nephews, having a few beers with her brothers, playing with all the neices and nephews on Songkran. The CO seemed to really like all the family shots, who/when/where. Just glanced at the phone logs, Western Union receipts, cards, e-mails. Asked how often we communicate and fiancee said every day a couple of times a day. The CO seemed to put more emphasis on the photos than anything else.

Quick update. I just returned from a two week visit back to Thailand. We took roughly about 100 pictures of us together and with her family all over thailand. Also we printed out about 275 pages of skype conversation going back almost 2 years. We sent the evidence back in the friday before last. It's been a week and i'm getting anxious. I hope we gave them enough. Does anyone know about how long till we would hear an answer?
