Tax return for interview - Been told by attorney proof of income is enough for now

Hello everyone,

I've been told by my attorney that if my last three years of tax returns are below poverty level, I can show letter of employment (I've been employed and make enough to be above the poverty level). He said that I need the tax returns when I'm filing for I-484 (I guess when we're getting married). I just want to confirm this, does she need to take the tax returns with her, and if she does and the I'm below poverty level, is my employment letter enough to grant the visa? Any thoughts?

Just curious as to how your letter of employment as to what you earn woudln't correspond with your tax returns, won't that create an issue later? I thought all consulates wanted at least the most recent tax return but I would check what is specifically required for your consulate.

Your fiancee will need 3 years worth of W2's and proof of income for her interview. Have your employer write a letter stating your position, wage, hours per week. It also helps if they write about your prospects for advancement within the company. I would advise sending some current paystubs as well. As long as you currently make above the poverty level for your household size and you have proof of that, it should be fine.

When you file the I-485 (after marriage), you will need tax returns, proof of income (paystubs), and a letter from your employer doesn't hurt either. We got an RFE to get a letter from my husband's employer and to provide 6 months worth of paystubs.

Be advised that for the I-864 (submitted with the I-485) you need to show that you make 125% of the poverty guidelines for your household size.

I was self employed for the last couple of years... I started with a company about four months ago... will that be enough for now? what I want to know is if I am making enough money now (from the past four months), will my tax returns cause any problems on the visa? I just want to make sure she will not get denied because of the tax returns

There's no "certainty" with immigration. As long as you can prove your current income (letter from employer, current pay stubs) exceeds the poverty guidelines, you shouldn't have a problem.

It's doubtful they would deny you outright for that reason, they would make you get a co-sponsor if they were worried about income.

Your current income is what is most important, so provide documentation of that with the employment letter and most recent pay stubs, if you wish to show even more documentation. You only need to provide a tax transcript for the most recent tax year, 2011 in this case.

I would follow the VJ Guides before I followed any lawyer's advice. Sending the returns will not hurt and just corraborates your story about your employment history. Many don't have previous years of good income and get approved.
