Hi guys,

So I really need to start driving. Its actually becoming a huge hinderance! Does anyone know if its possible to apply from a license, specifically in California, whilst going through the adjustment process?

AOS Journey

Day 0 - 07/10/2012 - AOS package (I-130,I-485, I-175) mailed to Chicago with FedEx.

Day 1 - 07/11/2012 - Confirmation from FedEx that package arrived and was signed for.

Day 3 - 07/13/2012 - Text confirmation from USCIS of receipt.

Day 4 - 07/14/2012 - Online banking shows that cheques were cashed.

Day 9 - 07/19/2012 - Received 3 out of 3 NOA letters in the post.

Day 11 - 07/21/2012 - Received biometrics appointment letter, appointed set for 08/07/2012.

Day 16 - 07/26/2012 - Completed biometrics walk in.

Day 56 - 09/04/2012 - Received text notification to state that my EAD has been ordered into production.

Day 59 - 09/07/2012 - Received 2nd text notification to state that my EAD has been ordered into production.

Day 62 - 09/10/2012 - Text notification that EAD has been mailed.

Day 64 - 09/12/2012 - EAD received in the mail.

Do you have your EAD yet? You will need proof of legal immigration status, social security card, and proof of residency in the state you live in.

You can either take your I–797 (NOA) stating you have started your AOS process or wait for your EAD (Employment Authorization Card) and go to DMV, they will issue a temporay DL for you.

Not every state accepts this. I don't think CA does.

Well, the information is on the CA DMV official website, linked on my previous post.

"Only the original or a certified copy of one of the following documents is acceptable:

- Employment Authorization Card

- Notice of Action (I–797 Approved Petition) – must indicate approved extension of stay or change in status that grants temporary or permanent residency, or indicates that an original, duplicate or renewal Resident Alien card is forthcoming."

What the op has is an I-797C, which is merely a receipt denoting you have applied.

As Harpa said above, what the CA DMV will accept needs to be an I-797 (no C), which is an approval notice (printed on security paper; the I-797Cs are now low-quality crappy paper to make exactly this distinction).

And op, once you have your EAD, that is usually acceptable in most states to receive a driver's licence, provided you have a social security number (which can also be obtained using an EAD).

I called legal presence in sacramento asking the same (i94 no date etc) but u have to wait for the ead.

I believe they require a SSN, don't they? You can get that with an EAD or a green card.

Is there a way to avoid waiting for the SSN?

No you also need the ssn. And remember in cali you can only drive for 10 (?) Days on ur intern. Or out-of state license once u live there and r considered a cali resident by living there.

Well I guess I shall just have to wait for the EAD. All I can do is wait I guess. I guess I was hoping it would have come already, but hey, I bet we have all felt like that. Ultimately, I guess I can still drive on my UK license, it just would have made it much easier.

Someone bumped a thread not long ago about getting fined for driving without a license in California. The person had a valid Canadian license, but the officer said the fact that he was applying for AOS proved he was a resident, and therefor required to have a California license. He ended up paying like $1000.

Hopefully that was just a one off case. But if you get pulled over, I'd stress that you're NOT a resident, yet.
