Hey guys, I have a question since i am going to start the process of being a citizen very soon. My brother is undocumented here living in the united states entered legally with a tourist visa just overstayed his welcome he works and pays taxes and so as soon I become a citizen, how long will it take for him to become a resident ( is it as quick as couples doing aos? ) I ask this because his daughter is a us citizen whom is 18 years of age and so we are trying to find which would be a better method for him to gain residency (he is unmarried ) thank you guys for all your help!! :)

Siblings cannot adjust status.

When his daughter is 21 she can petition for him.

If you apply the wait is between 10 and 23 years depending on where you are from. If his daughter applied when she is 21 the wait is shorter but she is not eligble to file for a wavier to deal with the overstay. The ability to do that goes from USC to Spouse or USC to child , not USC to parent. So he will have to wait out the 10 year ban. The only path would be from you to file for your common parent and that parent could file the waiver for the brother.

This will not be over quickly. You will not enjoy this.
