Expired Forms

I was reading on here in another section about the use of expired forms. I went through to check all of mine and all were okay except the I-765. I remember downloading it on this site a few months and started working on it. I later downloaded the other forms and so on and so on and well, to make a long story short, I ended up sending the expired form. (Yes, stupid me. I should have checked). So, the USCIS site says it accept previous editions, is that true or will they actually send an RFE for it? Will they return my entire packet? I haven't yet received a NOA1 but then again I just mailed the packet Aug 3rd. From reading others timelines, it seems they come fairly quick so I am praying ours comes soon!.

Oh the one I sent in was Rev 1/19/11 - the newest one is 4/25/12

Anyway, any thoughts.....knowledge?

From the I-765 notes, it appears they will reject your application.

"Edition Date: 04/25/12. (Previous editions, not later than 05/27/08, also accepted.)"

Since your edition is later than 5/27/08 then it will probably be returned to you.

Are you talking about i-765? I do not think it would be a problem as USCIS accept old forms for some of the cases(not very old). Even I made the same mistake .

But I do not see any difference b/w the old and the new form except it can be saved with updated content now.

You're fine; by not later than 05/27/08 they mean "not older". Yours is more recent.

From the USCIS website:

Current form date 04/25/12. (Previous editions, not later than 05/27/08, also accepted.)

There is no way to tell until you can tell, know what I mean?

I've heard they accepted them and I have heard they didn't.

Be strong think positive! If you get an RFE you will know what it's for.

Yes, that is bad wording... they should have used "not earlier than" or "after 2008" or something.

NOA1 just means they have your petition, they haven't reviewed it or anything, so no.

Once it's passed the "Acceptance" stage then you will be ok.

That typically takes a few days, perhaps a week. It's where they check the form is functionally correct: the correct fee was submitted, it's an acceptable form version, contains an original signature, etc. It's a very basic check which has nothing to do with the merits of the application itself.

Yes, I second Hypnos. If you received NOA1 it means the forms and application were accepted for processing.
