Concurrent filing i-130/485 for parent with b2 visa:

Having looked at other visajourney posts, it seems that it's not visa fraud to apply for permanent card while visiting the US. I'd like to apply for my mother who is visiting (multiple visa; month 3 of her stay; I'm a citizen).

I don't see anything in the USCIS documentation that would bar someone like me from applying.

Thanks!

There is nothing that prevents you from fiing , but if your mother was asked anything when she entered about immigrating she could in theory get accused of immigration fraud and have a lifetime ban. Does it happen often, no. But do you want to risk being the one it does happen to. You can file the I130 and she should have her interview and green card in less than a year. It would also look odd that she visited with a police certifiacte and her birth certificate.

This will not be over quickly. You will not enjoy this.

Yes, in theory, it seems possible to get burned. But do we know of documented cases here or on other forums where this was actually the case for some people?

Thanks for all the help!
