IR1/CR1 after the J1 visa

hello every body

I am Egyptian citizen i was on J1 visa (it has the 2 years home residency requirement) and during my stay in the USA i married an US citizen lady , i didn't apply for any marriage based immigration green card yet. now i have been in egypt for 1 year and i have another year to go before i can get immigrant visa to the USA . i am intending to apply for I130 .my question is

after the 130 gets approved i am gonna still be inside the 2 year window ,

Can i apply for the IR1/CR1 visa before the 2 years are done but still will finish the 2 years before i travel , for example the 2 years will be done in 15 august 2013 , can i apply for the visa on February 2013 and get the visa start date starts from 15 august 2013 so i can get the best advantage of the time i am away from my wife and in the same time i still follow the rules and the 2 years home residency requirements ?

Yes, you can have the petition sent on your behalf now. However, the visa will not be issued until the 2 year HRR is complete. They will not issue you a visa and trust you'll wait out your obligation

My visa interview took place on the first day I was eligible to be issued a new visa after my home residency requirement. Everything else was set for about a month beforehand, but we had to postpone the interview until that date. So yes, it's perfectly fine to do that. Good luck!
