Late AOS filing need advice?

Hi

While i was filing for my K1, I worked on it fast cause I was badly missing my fiance (husband now). I arrived here, Oct 3, 2011. We got married Nov 11, 2011 (11-11-11). Anyway, as you can see, it's already almost a year since I arrived the US. I already have the documents I need to fill out for my AOS but I haven't been working on them! I know i've been such a slacker and that's because I am finally with my husband but of course I still want to fix my papers! Question is, am I going to get in trouble for filing an AOS this late??? I'm so scared!!! :( I don't want to be separated from him anymore.

No, you will not get in trouble. You will not be able to us AP, however.

8/17/10: INTERVIEW DAY (day 123) APPROVED!!

5/23/12: Sent out package

you should be quiet fine, as long as you satisfy the requirement of the visa which is getting married within 90 days, your good. you do AOS as you like, you have people waiting longer due to the cost

Timeline

AP is Advanced Parole and is the application for travel document. Because he accrued overstay from being out of status (expiration date of I-94 and filing of AOS) he can't leave the country until he gets his green card. Well, he can leave the country, but when he does he will incur a ban and can not re-enter without filing for a CR1 visa and some waiver. It has been a lethal trap for others unaware of this detail. The big picture is you are fine and he is here legally. Do not plan on any travels outside of the US until he has greencard in hand.
