Just curious...anyone's SO tried to get here by applying for a student visa?

12/28/06 - got married :)

02/05/07 - I-130 NOA1

02/21/07 - I-129 NOA1

04/09/07 - I-130 and I-129F approval email sent!!!!

04/26/07 - Packet 3 received

06/16/07 - Medical Examination

06/26/07 - Packet 3 SUBMITTED FINALLY!!!!

07/07/07 - Received pkt 4

07/22/07 - interview consular never bothered to show up for work.

07/29/07 - interview.

True, though he is intending to attend a University once he gets here. Unfortunately though I just read that you have to prove that you won't abandon your country so it's probably as impossible as getting a visitor's visa. Oh well.

True, though he is intending to attend a University once he gets here. Unfortunately though I just read that you have to prove that you won't abandon your country so it's probably as impossible as getting a visitor's visa. Oh well.

Perhaps at the time of issuance (for F-1); lots DO abandon after the fact (getting CPT/OPT and then converting to work visa such as H1-b, TN-1, etc).

For J-1, it is typically necessary to do some "home country residency" (which causes lots of migraines).

If I understand it correctly, he would also have to prove that he's got the funds to pay to attend a Univ. here and since he'd be paying out of state tuition, it would be very expensive. I doubt it's something easy to get if you're from a "third world country".

Correct about proof of funds, but he could get a USC sponsor to show funds. Of course if his sponsor ends up marying him, well then very suspicious for CIS.

Right. Actually he will be attending for free because I work for the University and my husband and my children and me all get free tuition.....so now that I think of it...faggitaboutit since we'll have to be married before he can attend anyhow.

hahaha. I'd rather remain a wee bit more anonymous on the board. Actually though, the more I tell people about it the more I'm finding that it's a well kept secret that most colleges/universities don't charge full time employees and their families tuition. I knew this a while ago and always knew that I would work for one some day since no way would I be able to save that kind of money for my kids.

Some colleges are doing away with this benefit but if you get in before that happens you'll be grandfathered with the benefit.

I'm thinking it would be hard to get a student visa if he were married to an American. They may suspect that he would want to stay.

I know you said to forget about the question, but My husband came here on an F-1 before we met. So has a few friends of ours. From my understanding, you might think that it's easier to come here on an F-1 visa, but from what I have been told it's very difficult. And it's way more expensive. Now my husband and a few of our frinds had all the intentions of going back to Morocco, but fell in love and got married. None of our friends had any problems with the AOS. We are hoping for everything to go smooth as well.

I don't know anything about the J-1 to be honest with you.

If I am not mistaken, the J-1 requires a two year return to your home country after completion of your education and the F-1 does not carry that stipulation.
