hey friend let's put it this way...his brother crime won't be your husband's crime. it doesn't mean they are brothers!!!!!

as long that your husband will never be Accomplices, Accessories, Aiders, and Abettors to his brother crime...he'll be okay. just be truthful that's the key.

if ever they ask him about his brother...i guess its better tell them what he knows and he has nothing to do for what he did...obviously that his doing the hardway not the easy right? so chillax :thumbs:

You don't want to risk misrepresentation by not telling the truth. Misrep carries a life time ban. The answer must also be marked on Form I-156, question 37 Is any of the following persons in the USA....brother/sister. If you don't mark the box

and say at the interview no, I know no one being in the USA then it is a misrepresentation.

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

I so agree with all you. This is not an issue with me. My husband is just so upset with his brother for being so mysterious and saying "forget u know me don't mention me"

My husband doesn't believe all the tails we have told and read here of facebook accounts and emails read. I told him unmm your mom and dad is on the forms submitted and I am sure your brother put the same name.

He just feels saying no is better than being associated with his brother.

Goodness what a hot mess. Well just pray for us.

Where's that emoticon that bonks people over the head. Cuz they both need it. ;)

And honestly we have no idea where his brother is. he doesn't communicate much accept to post a different city he is in on Facebook. We have no idea. So ignorance I pray in this is bliss. Thank u

I-156 is for K1. We don't have any questions to family in the US for IR1/CR1.

But I get the point. Just I am not the one being interviewed and he is just not getting it.

Well as for me in the column you were asked such question,i will advice you to just blank it that writing something that might implicate him in the future.For the brother to say that you guys should not include him means alot than you can ever think or imagine.He might have a situation down here that he is trying to fix and he doesn't want it to affect your journey.Debbie go ahead and do your job.I have similar situation during my case but you may be surprise that it may be overlook on that day.

Do they really need to know the status of his relatives? my fiance has cousins here but we don't know all their statuses plus people lie to each other so much. So thats not even a fair question to begin with. His brother seems to just like to lie, and i doubt they will send out a search team for him if your fiance says yes i have a brother in us. He tell them they are estranged though, so he has no idea what he is doing here.

Knowing family members status no. But yes lying because that is withholding a material fact that is what gets you a denial and a ban.

Well, when someone starts a thread that says "Hey, my husband's brother told him to lie, so I think my husband is going to lie, but I told him not to lie, what should I do?" And everyone responds, "You are right dwheels! Don't lie!" and then a countrymen (two now) come in and say "Yes, lie, it's not their business, just lie, I am going lie!" it's enough to give anyone pause.

The vast minority of people adjust or overstay from VWP, or else the US would remove hat country from the VWP list.

I think the country must have something like under 3% tourist visa denial rate to be able to have the VWP (and a few other conditions). Lying would cause visas to be refused, so at least 97% of the applicants tell the truth.

It really seems like the blind leading the blind when the advice is "Just lie like I am going to!"

I understand your point. My whole thing on this wasnt "what should he say lie or not" It was more can he get in trouble for whtever his brother is doing. I think for alot of immigrats family come here all kinds of ways (not just from Nigeria) and well its scary. They don't hear from family member don't know whats up. And frankly scared. Than you have a brother out the blue cuz he hasn't been talking to family since he came here blew through tuition money in a month got kicked out of school says he got green card and well now trying to get in military.

Most think ommision is best they see no point bringing up dead things. He's not trying to be sneaking he feels he is protecting himself. No matter how much I have said thats a misrep if they say no you have brother here. We don't even know where his brother lives he won't say and he thinks I am working some covert secret mission to out him asking for his address. He just says you don't know anyone in US. Goodness.

Omission is when you leave something out, this scenario is specifically answering the question with a lie.
