Timeline

Those who been through or know of the interview process. How much does this question weigh on approval or denial?

Like if you had a brother, sister, cousin that lives in US and their status is questionable what do you do?

What would happen if the immigrate said "no only my SO I know".?

And what if the family member os in US legally (you think) and come to find out they committed fraud or whatever to get greencard does that affect your Visa?

Your status is your responsibility. Don't risk that for someone else because it is unlikely that they will do the same for you.

I agree with telling the truth, and if one isnt sure of the legal status of a family member, they should say so, if asked of course. Ahhh, Lagos, can they deny a visa based on a family member being here illegally, I wouldn't think so, but they may wrap it up all neatly with a bow and use some other term for denial. Now I am not saying they would, but you and I both know how difficult this Consulate can be. To judge one family member based on another member's actions is wrong and biased. If all other requirements are adequately met and proven, yet you still get denied with no clues as to why, I would say, fight them on the discrimination.

Thank you all for your response. And well of course he will answer truthfully.

I guess what we are concerned about is the actions of his brother. See he came here 1 1/2 years ago on a student visa left school and 6 months later announces he has a green card. Now he is getting ready to enlist in the Navy.

I have read a lot and didn't know you can get a green card from a student visa without marriage.

And just 2 days ago when talking to him he tells me "I wouldn't tell at interview you know anybody in the US but you".

So I am scared and confused what his brother did and will this affect him.

All my husband can say is yes my brother went over for school and last we heard he was enlisting which is the truth. Personally I don't want to know what he did. Goodness.

07/26/2012 - 10/18/2012: 85 Days from Application Received to GC Received.
Removal of Conditions
07/22/2014 - 11/14/2014: 116 Days from Application Received to GC Received.
Naturalization
02/03/2016 - 05/31/2016 : 119 Days from Application Received to Oath Ceremony.

I am a United States citizen!

Possibly the Brother is operating partly under an assumed identity. There were some servicemen at my swearing in ceremony and I am not sure how they get in the service without already being a citizen, so who knows.

What i've learned is that the best approach is to be honest and let the chips fall where they may.

That is not something you should worry about, you need to be honest in all questions. Maybe not now, but someday they will find out if you lied and it will be hell. You are the USC and are petitioning her, that is all that is required for her to be allowed a CR1.

Honestly I don't think he should lie to the CO because as said by someone else, they know the answers to the questions they're asking. He can be put on AP or worse denied making the whole process even longer for you. I hope you two can figure something out, good luck :)
