August 2012 AOS Filers

So, this is what the instructions says...

"To qualify as a sponsor you must demonstrate that your income is at least 125% of the current federal poverty guideline for your household size"

I think they ask for tax returns from previous years in order to prove that you are a US Citizen and, if you were living abroad, in order to maintain that status.

Tax returns from previous years are optional. i only sent in my husband most recent, which is the one he files this year for 2011 tax year. If you meet the income requirement for 2011 tax year, then you wouldnt need a co sponsor. if you were to file AOS next year, then your current income would be enough since you meet the requirements now. They are not considering your current income even though you make enough now. they are looking at your income in 2011 and you didnt meet the requirement in that year. If you have assets, then you can go ahead and get them appraised and send them in or if you can find a co sponser, that would be the easiest thing to do.

If that was the case, lets say that in 2011 I made 100K (show taxes for that) but now in 2012 I am collecting unemployment for 11K (household of 4). Are they going to give me a GC based on last year when I can't support the household now? Don't think so

They probably would ask for a co sponsor. my husband lost his job after we submitted the package and is currently on unemployment. They didnt care about how much he's receiving on unemployment. They cared about how much he made in 2011 and that was more than enough to sponsor me..Or maybe because his income on unemployment was still more than enough.

If that was the case, lets say that in 2011 I made 100K (show taxes for that) but now in 2012 I am collecting unemployment for 11K (household of 4). Are they going to give me a GC based on last year when I can't support the household now? Don't think so

I know it seems stupid. but the rules clearly state most recent tax return. 2011 is the important income.

And to answer your "what if I am collecting unemployment in 2012" that is why they also ask current employment proof just to prove income continuity, it never says 2012 income has to meet poverty line.

Finally after 5 months of waiting i got my arrival/departure records from CBP(FOIA). I feel much better that i have it to take to my interview. Congrats on you biometrics. Time for the waiting game for EAD production and Interview notice

I lost my I-94 and did not get a replacement, instead i FOIA'd my arrival/departure records so i can have proof of my legal entry(also my I-94#). I was told that they generally ask for and keep your I-94 at the interviews.

iaia- I'm so sorry that your situation is a bit more complicated than you expected. I don't know much about it so i can't input. I do hope that you can get a clear picture f it at your infopass appt. Good Luck

jessie lost her I-94, she got that replacement to prove she entered legally

I lost my I-94 and did not get a replacement, instead i FOIA'd my arrival/departure records so i can have proof of my legal entry(also my I-94#). I was told that they generally ask for and keep your I-94 at the interviews.

I'd never guess that the RFE was about the affidavit of support. Sean got really screwed with the taxes last year since they never 1099 him. That also stopped us from buying a house when we got here. Thank god we still have assets to put in the paperwork

I believe that will work for you . also i think u can request I-94 but im not quite sure about it .

hahaha!! I wrote in the googledocs chart possible I-94 RFE on your case.

It's just that I have been obsessing about all this mess, counting days and all possible outcomes and solutions if I got an RFE, which now on my day 34 I feel I am almost safe from getting one.

My EAD and visa expired last week, and there is nothing I can do.... except hoping my job doesn't notice until I get the new one (probably in a month)
