Already got a room reserved, but it won't be much of a night, we can't hit the road until 7PM which means a 10-10:15 ETA. The annoying thing is it means my wife has to miss a day of classes. Fortunately, her professor puts the lectures online for the benefit of the distance students.

when did you send the RFE response?

I received the hard copy on the 13th and mailed it back via USPS the same day. It showed as delivered the next Monday (the 17th) at 4pm.

Unbelievable!!!! I called and after 40 minutes on the phone waiting to talk to an ISO, they told me now to wait 30 DAYS!

#######?! 30 days for a letter that already didn't came?

What is wrong with USCIS?!

Beyond pissed and frustrated right now. I can't believe they can't even tell you what do they need. The ISO was useless

WoW!! After this morning 30-day bad news, it's great you got it! What date was it postmarked? I mean all this time was post office or did USCIS keep it for a few days before mailing it?

What was the problem with affidavit if you don't mind?

The letter days that Sean doesn't meet the 125% last year so they need complete tax return for 2011. Apparently I sent the wrong one.

It also says that he meet the income requirement this year so they need proof of income, like letter from employee, pay stubs, etc

What I don't understand is that point 2 and 3 are contradictory. If we do meet the requirement this year and submit proof of income, why do we need the assets? Uscis couldn't explain on the phone why

You have an infopass this week, right? they might be helpful. (or They might not from what we've seen!)

Remember sometimes those stupid letters have general template answers and are not precise to your case!

but if you want to share more info about incomes from different years, we might try to figure out what's their deal.

Household of 4 is 25,000. Are you sure you send the wrong one? Maybe they misplaced it!

did you send transcripts or tax returns?

Did you use the right income? it's adjusted gross income for taxform-1040EZ or total income for taxform-1040

You only need to meet the income in 2011. the other years are just for context.

Household for 4 is correct. Sean was working for a company based in Canada and when this place presented bankruptcy, they fired everyone and didn't 1099 them so the income for 2011 is low. I did sent the wrong file from the tax returns, I asked Sean and he gave me the tax return you get on your mail after filling and NOT the 1040EZ (no biggie, I can send that). We (sean) meets the income requirement this year 2012, so they asked for the letter from employers and pay stubs (i got those too)

Now, the letter says that since we do not meet the 125% (we do not for 2011 but we do now) we need to submit the assets that we have (properties, bonds, etc)

What I do not understand is that since they are asking for income proof for now to meet the 125% why do we need to submit the assets too.

It is contradictory that they say we do cover and exceed the 125% now and ask for the assets. Makes sense?

I think that even if you meet the requirements now, which you will prove with paystubs, you still have to fulfill the 2011 required income, and that is why assets are being asked

Technically the grant GC based on last tax year. not on partial current year.

It's silly but if those are the rules, I would imagine that even if someone is making $100k, and was just hired 6 months ago, if his last year taxes say zero. You need a joint sponsor to meet 125%. 2012 income helps your case, but doesn't count. The only 2012 things that counts for 2011 income proof is assets.

So, this is what the instructions says...

"To qualify as a sponsor you must demonstrate that your income is at least 125% of the current federal poverty guideline for your household size"

I think they ask for tax returns from previous years in order to prove that you are a US Citizen and, if you were living abroad, in order to maintain that status.

It doesnt say that you need 2011 (in this case) income proof for sponsorship.

If that was the case, lets say that in 2011 I made 100K (show taxes for that) but now in 2012 I am collecting unemployment for 11K (household of 4). Are they going to give me a GC based on last year when I can't support the household now? Don't think so
