I keep checking every day on the USCIS to see if I have an RFE. I don't trust the text alerts!

The only thing I'm really worried about is something someone mentioned on another thread about being denied AOS because USCIS say that he left (his airline logged him as leaving the US.)

I only cancelled my ticket the day before as I didn't plan on staying here at all so I hope my cancellation showed up. I did it by phone and didn't get a reference number or anything. We shall see, eh? The worst case scenario is that I have to back to the UK and do CR-1. Not the end of the world but a little frustrating!

11/29/12 - AOS Interview in Atlanta - 10 minutes long and approved on the spot.

I read that too and I also didn't cancelled my flight. But they are many holes in that post. I mean, if you leave the country you need to present your i-94 at departure. If s/he has it, means they didn't left, right? Also, you will have a stamp in your passport from entering the other country.

Honestly, some bases for approval/denial (for what I read) are ridiculous.

I'm still going to attempt a walk in tomorrow. Hubby has the day off work and I can go while he take care of the twins. Maybe I should go to the mall too and come back at night for dinner. Anyone would like to join me? hahaha

You're right - at least it wasn't a denial!

I read that forum too, and it worried me at first but now I've let it go! We didn't cancel our flight either - return tickets for both of us. I have actually never called and canceled tickets - and I have changed my mind about coming home from SA or him staying here a few extra days a lot over the years. It didn't even occur to me it might be a problem. I can't imagine anyone not being able to come up with tangible proof that you didn't leave - I agree there are holes in that story.

I'm thinking Friday after his biometrics we take a deserved break on Bourbon Street...but shopping would be nice too :lol:

The biggest problem I have is that if the USCIS do assert that I left (depends on my airline updating their records) then I can't appeal because I was visiting on the VWP. Tanja is in the same situation as me I think?

I was visiting from a 3rd country where I had a work visa so they would have had to stamp me back in for me to have been on the flight anyway - which they obviously didn't!

I would try a walk-in early, but it's about 90 minutes away by car. A long way to get refused at the door!

My dates haven't changed; my I-485 is on acceptance, my I-130 is on initial review, and my I-765 is on initial review also.

11/29/12 - AOS Interview in Atlanta - 10 minutes long and approved on the spot.

Goodness, that's scary!! Made me check my online status also.... nothing so far but I know anything is possible and an RFE could come at any time!! Gesi never left either, we didn't cancel the flight. I have never cancelled before so didn't think to this time. We just bought a new ticket or paid to rebook. But that is a good point about the initial I-94 and passport stamp. I saw that post as well but didn't read it. I try to stay away from the negative as it tends to make me a worry wart! lol

Tomorrow is our original biometrics appt which was done Aug 31st so hopefully we will hear something soon!
