Hey guys,

My husband and I are currently filling in the I-130 and theres a question I have regarding question 17.

It asks to name the children of the alien relative (me) I have a son but he will be staying in the UK with his father,his decision which kills me but I respect........do I still have to name him as my child or does that only apply when youre bringing your kids over to the US aswell?

Jeeez this gets confusing!!! :blink:

Answer the question. It asks to name the children, not to name the children who are ONLY going to the US

With a Cr/Ir1 visa your son cannot 'join' you without a petition of his own. They won't assume that once they see that a petition has not been submitted on his behalf
