My wife and I recently got married in Poland and are now looking to get her legalized to go back to the States. She is a Mongolian Citizen and has been in Poland for about 11 years and is currently on the last bit of her student visa. My visa in Poland will end in a month and I will be returning home to California. We are trying to get my wife legal to come to the US as fast as possible seeing as being apart won't be a very enjoyable time.

So I have a few questions.

My wife originally applied for a Tourist Visa to come visit me for a while in the states at the end of 2011. At the time we had been apart for quite a few months already and were still dating. She came with the intention of simply visiting and to continue dating. During this time our relationship developed very quickly and I asked her to marry me. A week later she returned to Poland to finish her last semester of school. At the end of June this year my family and I came back to poland and we got married. Now 2 months later (yes I know, we dropped the ball on submitting the I-130) my visa is running out and we have decided I should just go back home and get a place for us to live and a job. She has to stay at least until October to finish her graduation stuff. Is it possible for her to come to the US after she is done with stuff in Poland? I understand she would not be able to stay on a Tourist Visa because that would be immigration fraud, but could she stay for a few months then return to her home country of Mongolia for the Interview?

We are just trying to find a way to make all of this work with the least amount of travel and making sure all the visa's are ok for the countries we are in.

It may be possible for her to extend her visa in Poland if that is going to be easier for her to come back here for the interview and such.

Is it possible for her to come to the US with intent to leave after a few months just so we could be together during part of the processing time for the I-130?

I really appreciate and help on this issue. Any advice would be fantastic too.

If she has a valid visitors visa she can try to come, but what would her tied to Poland be if they ask? She no longer is going to school, does she own property or have a job to return to. If questioned there is a high probability that she would be turned back, spouse of a USC , no schooling, job or property to return to. It would look like she is trying to immigrate.

This will not be over quickly. You will not enjoy this.

Just wondering, what did she study for 11 years?

I would have thought studying a bit longer might be the easiest solution.
