lost job, just got NOA2, but i do have a cosponser

Ok, so i am a bit confused. I just lost my job not to long ago and yes i am tryin to find a new one but its becoming very hard! I also have a Di sponsor lined up. So how will this work? Will she be required to support me to if i can't find a job at this time? She does not live with me, she lives in a different state. So if somebody can help me out thank you. As i am not finding to much on this on VJ, as i am using my phone. Ugh

The foreign spouse is being sponsored, not the US Citizen. Time to download and carefully study the I-864 INSTRUCTIONS.

I know its for my husband and not me. My question is since i don't have income can i still file i-864? Im just tryin to figure this out becuz of what somebody said. Since i don't have income they won't deny him correct? If i don't find a job in say a week

Yes, you will still have to complete the I-864 along with the co-sponsor. I would suggest for you to include a letter explaining you job situation and the past 3 years of your tax return to show that you had been working till recently.

remember - you have up to a year to file the I-864 into NVC.

Even then, lets say your situation changes, from unemployed to working again, over the next few months.

you have income tax data from prior years,

and you have CURRENT INCOME for THIS year, from the prior job and the new job that you'll get next week (I am positive for you)

then you should have no problems filing an I-864 on your own.

However, assume you have a co-sponser for today .

You file the I-864, the co-sponser files the I-864 and then...

IF your situation changes for the better by the time of INTERVIEW DAY, you can get a new I-864 set (solely on you) to yer spouse, spouse brings it into interview, hands it over to VO, asks for the TWO I-864s sent in to NVC to be returned right then and there; a swap, if you will.

Come back to VJ on a PC, a LAPTOP, or some other computer. HandPhones SUCK when yer trying to learn here, to do research. You really need to read the I-864 instructions and spend about 10 hours with your research time, using a PC.

Yes, but that question in answered in the I-864 instructions, of which careful study will be critical to your ultimate success. Start there.

K. Well i just got a job that i was offered last week. She just called me :) i still have to have a co sponser cuz i have kids that i claim and great clips don't pay enough. So i still have to have a employment letter from my old job i had in WA? I know i have to have it for this job. With same comp. I been with for a while. I do have 3yrs tax returns for myself.... but now at least i have income. Whew! Thanks guys :)

A pay stub will do. Employer letters are not a requirement. Since you don't qualify, verification of your income is not critical. Focus on the joint sponsor.

Make sure that you have last years income for both of you, I read several times from other JA members that JA will look at last year's income also, regardless of what current income is.
