Delay I-864 packet

Hello everyone!

I love this board. It is so helpful. I have not gotten married or sent in my I-130 petition yet, but I am trying to think ahead in regards to the Affidavit of Support.

Quick background...I am a USC and I live in Brazil (on a work visa) with my Brazilian fiance. I have been in Brazil for more than 3 years and we have been together for almost 2 years. We plan to get married next month and then start the CR-1 petition/visa process to move to the states after my contract ends (June 2013).

Here is my problem. I work abroad so I do not have income in the states. I have filed taxes every year and can show income above the minimum requirements. Since I do not have a job in the states or one that will transfer to the states, it is my understanding that I will be the primary sponsor, but I will need a joint-sponsor. I do not want to ask my family or friends to fill out an affidavit of support for my future husband. They have met him (he went with me to the states to meet them last month on a tourist visa). I believe they would do it, but I do not feel entirely comfortable asking considering the legal liability I would be asking them to accept...continuing even if the relationship does not work out the way fairy tales...I have read a few horror stories on here.

In order to be able to be a sole sponsor, I have been considering going back to the states in June 2013, alone, and finding a job asap. Wishful thinking leads me down the road of getting hired in July for work beginning in August/September. I am a teacher. Hopefully they would be able to give me a letter of employment with salary (assuming this would be sufficient for the I-864...correct me if I am wrong.)

Now to the questions...

1. When we get to the I-864 stage are we able to delay by not sending in the paperwork for several months? If so, how long can we delay?

2. After the I-864 is sent in, what is the average time to complete the process in general? If you know more specifically about Brazil that would be great. I know this is just a best guess and that each case is different.

3. Any other ideas about how to go about this?

Sounds like a good plan. You can delay up to a year. A letter of employment would not be enough, though they MIGHT make an exception. Generally, you need to show you've started the job and have received pay for it.

When filing from abroad, it's usually pretty fast from the last paperwork submission to interview. Maybe 4 to 6 weeks.

A year as long as you make contact with NVC your petition stays active.

2. After the I-864 is sent in, what is the average time to complete the process in general? If you know more specifically about Brazil that would be great. I know this is just a best guess and that each case is different.

Well its not country specific normally when you hit NVC its about 2 months from beginning getting case#, AOS filing, IV BILL filing and case Complete than interview date assigned than off to embassy.

However you have to take in account time of year slow downs. less than like 6 months ago you could fly through NVC within a month. Since April it has slowed down alot so realistically plan 2 months to 3 months.

3. Any other ideas about how to go about this? I'll leave the other ideas to your Brazilian country people they may have some more to give you. I know that job gettiing and don't want to ask family. I just got a job July 9th after 19 months being unemployed. I too was living with husband all last year in his country so coming back looking for work has not be easy at all. But you will be fine.

I know others will be able to help you with the domicile thing and all that so you will be fine.

Update...I made it to the interview and was asked to get a joint sponsor. I asked her if it was possible to go back to the states and get a job and the resend my 864. She said I could not just get a job and a couple of pay stubs that I would have to wait until I filed taxes so it would be up to a year. She told me to get over my pride and ask for a joint sponsor haha. Of course I was not laughing that day.
