I-751 waiver joint lease evidence

Hi All,

I have filed a I-751 divorce waiver back in Aug 2011. 2 days back i received a RFE requesting for more documents on the below:

o Leases in both names showing joint occupancy; or deeds and mortgages in both names showing joint ownership;

o Joint checking and savings account;

o Joint Insurance policies ;

o Joint utility bills;

o Joint credit card account statements; and

o Wills or Power of Attorney showing you and your former spouse had made estate planning arrangements with each other.

I have already sent strong evidence comprising of marriage photos and dvds.However,since my ex and i lived in a house (for about 2 weeks only)ownned by his mom- i have no evidence of any joint leases or utility bills.

I really do not know how to proceed.

Any help is appreciated

I have also file a recent I-751, and as part of the "receipt notice," I received, basically, the same "mail" that you have. I can only offer you what I know based on my personal knowledge and education. As long as you have provided the USCIS with documentation/evidence asked/required for the I-751, don't worry about it. The USCIS is just giving you, in my educated opinion, a 2nd chance to make sure you have complied with what has been asked for...

what evidence did you originally send? it seems like they want to see evidence of cohabitation more than anything.

did you send drivers license showing same address? any junk mails addressed to you and your ex-spouse? letters or cards addressed to you both from friends and relatives?

unfortunately, photos are not strong primary evidence. and they dont even care to look at dvds. i know of people who sent their sex tape to prove bona fide....and still got RFE.

we need to know complete list of what you sent

Photos of a wedding ceremony (dvd's aren't accepted) are not enough to demonstrate a bona fide marital relationship. All they show is a big ceremony and party.

Unfortunately, for the short duration of time (2 weeks) - i have not received any postal mail addressed to both of us.

There is one certification i did to help with the family business.The records associated with that certification have my ex's address on it. This is the only evidence if it helps.

I have already sent joint credit card statements but somehow i still get a RFE for a joint lease ( we lived in a house and never in an apartment)

Not sure what to do.

Get the owner of the house to write a letter stating that you lived there. Be sure to have that letter include the dates.
