Hey, Visa Journey community. I got my biometrics taken before getting EAD with advanced parole. Then I received a RFE from USCIS asking for final court disposition on a false arrest 5 years ago. The case was rejected by DA so no file no disposition or anything. I mailed the certified doc over and a letter from Sheriff saying only USCIS can ask for arrest report directly on the 31st of July. Today I received a mail from USCIS asking me to take biometrics on the 20th of August.

Really puzzled here, why they need to take biometrics again as I've already taken one in June?

I would really appreciate it if someone could tell me what is going on.

Thanks so much!

They probably want to make sure the fingerprints are good. Or reverifying to see that everything checks out. Being overly cautious. Take your choice, hard to get in the minds of USCIS. It appears they are going forward with your case versus sending you NOID.

On another note, A sheriff stated that only USCIS can ask for an arrest report directly? And it can only be obtained on July 31? I really do not understand this. First of all, they are public records. Anyone can get them if they know how to. Second, they are yours. You are entitled to them.

Good luck.

But I like your interpretation better. :D

The RFE probably had nothing to do with the second request for fingerprints. If the first set of prints they take isn't clear then they send you a request for another. If the second set they take also isn't clear then they will RFE you for a police certificate instead.

Probably right, but seeing how the whole thing revolved around a "false arrest"..........

Thanks for the reply. Just to clarify, I received rfe received noticed on July 31st. The sheriff said only conviction is public record, mine was not even filed, so not for public record.

Hi, I guess the first set of biometrics should work as I received my work permit with ap after that.my lawyer said they may need another round of biometrics for green card. That I am not sure as the previous biometrics hasn't expired

I believe biometrics are valid for 15 months.
