I've heard stories from people on this board having RFE for missing birth certificate of the foreign fiancee. How popular is this RFE? I'm preparing to file K1. If I wait for this document from my fiancee, it could delay the sending of the petition by 2 weeks? It is worthwhile to wait?

Hi sealedkiss,

Check out the K1 guides link below for what is required in the I-129F petition filing. You will only need to include a "Copy of the Birth certificate (front and back) for the US Citizen or a copy of ALL pages of the US Citizen's passport issued with a validity of at least 5 years or a copy of the US Citizen's naturalization certificate (front and back). This is used to establish citizenship."

Yes, recently there has been a marked increase in RFEs for the birth certificate of the fiance, even though nothing on the I129F indicates that it is a requirement. Only you can decide if it is worth it to wait for your fiance's BC to send your petition - it's impossible to know in advance if you are going to get an RFE. Good luck.

Since an RFE can typically delay approval of a petition by two or three weeks (if you respond immediately but obviously no guarantees on the timing) then waiting two weeks or submitting now and dealing with an RFE, if you get one, might simply be a push. We do not know why they are asking for BC's when it technically is not required as it could be anything such as a birthdate, name or some other type of additional verification. I have thought that maybe including the identity page of her passport would provide everything a BC could possibly verify so you might want to consider that if it is more easily gotten but then again no guarantees that it will do anything or you.

So if you decide to go without it be certain to have your fiance' get it to you in the mean time, so if in fact you get an RFE for this you can submit right back. Your call and good luck

Thank you for your responses. I think I'll file it without my fiancee's birth certificate, but will have her send me a notarized, translated copy just in case I get an RFE.
