hi, vjs

We are having our AOS interview this friday. My husband doesnt speak english so I was thinking on bringing my sister as an interpreter. Will this be a problem since she is a family member? I have no one else to ask since its a friday and all my friends are busy working. Thanks in advance :)

Ok, I know this is a silly question but here it goes. Does he speak Spanish? If he does then of course they will have a translator present if the CO isn't fleunt.

No, the interpreter can NOT be a family member. The precedence is that a family member has a vested interest in the approval of the case.

It can be someone you know and trust. A friend. They have to be in the country lawfully with no criminal record. Can not be an immigration consultant.

USCIS does not provide an interpreter at the interview.

There is no law prohibiting family from being an interpreter. In fact, some people have reported that one member of the couple being interviewed translated for the other member.

Of course, that only works if the question to be decided is whether the couple can communicate together. If the question at hand is whether or not the couple is engaging in immigration fraud together, then it won't be acceptable. Even a non-family member can have a vested interest in the case, so relation itself isn't the only factor to consider.

You can't know what questions (if any) they have for you before the interview. So, if there is no one else, I would bring the sister, and ask if it's okay once I got to the interview. I would know there is an off chance that I would have to come back at a later time with someone else.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

I guess there are inconsistencies with different interrogating officers. Our friend had to use an interpreter for their interview and could not use a brother (told by the IO).

But, it seems others have used family members....

The information I gave you was from personal experience of a good friend. I work for a large university and we have tons of international students, post-docs etc.... There are a lot of immigration issues that come up monthly.

I apologize for stating this info as "fact". I made the fatal mistake of assuming it was a standard and not up to the discretion of the IO.

Good Luck.!

Thanks for all the help! I had the interview done in Spanish so we didn't need anyone to translate. My sister did go and I asked the IO if I could have her( my sister) interpret and she said if you want I can do it in spanish. So she would've been able to translate for us if needed :) thanks again.
