You can marry, then file to do Adjustment of Status. Many have done this with success.

My husband came to America on a B1. We sure had some explaining to do at the interview, but in the end he got his greencard. With that being said....I'm outtie..lol

It's a way of doing it, and a good option, but it's at a higher risk for sure!

this is what my Imigration Lawyer told me, but since we did not jump the gun, my wife has made an extra 20 grand at her job in France. It will take her a while to get a job here in the USA.

So God has come through for us! sorry to rub it in, but it's true!

by the way. we did not pay the imigration lawyer, she is a family friend.

so everybody is right, many people have done this with success and some people have been deported. I would not be able to take the stress knowing I did it with a higher risk. if you know what I mean.

end of story.

Please provide evidence of WHO has been deported. Links to their posts would be best. The only ones I have heard of had serious negative factors in their cases.

This thread is an example of what happens when a question of AOS from non-family visa gets mistakenly started in the wrong forum. Most people who adjusted from K-1 or CR-1 understand that AOSing from other types of visas is legal and appropriate, but others just really have a hatred that it is allowed and insist on providing erroneous and inflammatory advice.

Alas, you are correct...

I should have read more closely. The post says the baby is due this year and that she entered the country last year. I guess since this was a current post asking about AOS after entering...I just assumed the entrance into the country was recent. But, apparently, it's not. My wrong!

Where does it say she was pregnant??

My guess is that those same people wouldn't have had any more luck getting a spouse visa, either.

In all fairness, I did the same thing, but realized my mistake quick enough to edit. :)

Ha! I have tried to edit both of my replies, but the system won't let me...

I need to figure out better how to use this blog thing...

Marriage in less then 2 weeks after POE? Suspicious as hell.

The OP didn't say when the marriage took place.

I said that I married 11 days after my POE, but I am not the OP, and have adjusted status succesfully.

no, you CANNOT be deported for getting married while on your visitor visa. You CAN be deported for trying to adjust status while under a B-1 visa. BUT the odds are VERY slim unless there are SEVERE negative factors against you. If you intended on adjusting your status while on your B-1 aka visitor visa, then yes you will be deported. It all comes down to intentions. AND are you going be honest or try and lie to the IO's at the interview cause you WILL be found out if you try. At any rate, be honest, and youll be just fine. if you DID infact intend on adjusting status while here on a visitors visa, i suggest you return to your home country and do it the right way. only you know the truth at the end of the day. good luck

B1/B2-visa is no different than any other non-immigrant visa, such as F-1, J-1, or VWP when it comes to adjusting status to permanent resident in the US (except for the no-right-to-appeal part that applies to VWP entrants). Intent matters with ANY non-immigrant visa entry, except for the few visas that allow for dual intent, such as H1B.
