About to send K3 paperwork to Embassy now I130 approved - what is best option?????

Hi all, this is my first post here as I only discoverd this site last week and any advice would be appreciated.

My wife is a US citizen and I am english. My wife returned to the States in May 2006 as she was then 6 months pregnant and that was the latest she could fly home as we wanted the baby to be a US citizen also.

She filed I129f and I130 on May 23rd 2006 and we received a notice of approval for I129F by email on August 28th 2006.

I flew out to California for the birth of our daughter on Sept 8th 2006 for 4 weeks as work kindly obliged and gave me 4 weeks leave.

Upon returning to the UK my paperwork had arrived from the US embassy. I have a medical exam for the K3 booked for November 6th 2006 and was just waiting on my police certificate to arrive, it finally arrived yesterday the 20th October 2006 and now I am about to send in my paperwork for the K3 visa back to the embassy on Monday the 23rd October.

Yesterday the 20th October we recived an approval notice from UCSIS by email saying that my I130 has now also been approved with an approval date of 17 October

What should I do now? go for the K3 medical and is it the same as the CR/1 medical? ????? or will I have to have a seperate medical for the CR/1?????????

Do I need another police certificate if I wait for the CR/1 interview ????????

Shoulf I send in my completed K3 visa paperwork or wait until the embassy sends me the paperwork for the CR/1 interview, and is that likely to take long for me to receive from them????????

Also what would be the advantages/disadvantages of either option?????????

I know if I go to states on a K3 I will have to apply for AOS so is it easier to go on a CR/1 so I dont have to go through that process?????????

hi there

i dont really know much about the visa's your talking about but im sure you dont need 2 medicals or 2 police certificates..you usually choose which visa you want to go for...

the link above is to the forums for the visa's in question and im sure someone has asked the same questions you have asked...

11th Aug 2008 - Mailed I-751 to CSC.

12th Aug 2008 - Application received

14th Aug 2008 - Cheque cashed

18th Aug 2008 - Received NOA-dated the 12th

26th Aug 2008 - Received Biometrics letter

4th Sept 2008 - Biometrics-Detroit-Complete-'Touched'

5th Sept 2008 - 'Touched'

1st Dec 2008 - APPROVED-Card production ordered -112 days

8th Dec 2008 - USCIS mailed approval notice.

8th Dec 2008 - Received my 10 year Greencard in the mail. took 2 days.

Although I have the above date for approval my card actualy states the

2nd December..

As far as I understand, the medical and police certificates are good for 1 year - but it's probably best to get additional copies. Hopefully someone else can help more with this.

As far as what to do, you can interview for the K3, go to the U.S., continue the process for the CR1 and return to London for the interview (which seems like it would be faster than AOS, but depending on flights might be more expensive.

Or you can skip the K3 and just wait for the CR1.

Or you can interview for the K3, go to the U.S., and adjust status there. Biggest drawback to this option is that you won't be able to work until you get the EAD.

Many people return to their country for the CR1 interview after coming to the U.S. on the K3, but depending on your financial situation, how urgently you want to get to the U.S., it's really up to you :)

You should check out the wait times for the London embassy. If you go through with the K3, that is the only thing you'll be waiting on... the interview. After that, assuming you're approved, you can move to the US. With the K3, though, you'll have to wait for your EAD before you're allowed to work, like someone previously mentioned.

The problem with waiting for the CR1 is that even though the I-130 has finally been approved, you still have months of back and forth correspondance with the NVC before they'll schedule an interview date for that.

My opinion would be that it would be a lot faster to go ahead with the K3 and then adjust status once you're in the US, but I can't say if it's the right decision for you. It all depends on the wait times at the embassy, whether or not you'll need to work right away, and probably a million other personal factors of your own.

The medical is good for a year. I think the police certificate in Canada is good for 6 months, but it may be longer elsewhere. I'm not sure what the official USCIS stance is on the validity of police certificates. Anyway, if you did AOS in the US, you could probably re-use the same medical results. Make sure you make copies of everything.

I did both K3 & CR1.................K3 i arrived here in december last year with that visa, i applied for EAD which took 3 months just to get an appointment for biometrics, which i ended up not bothering with as i had already got my CR1 interview back in London scheduled, so i returned for that interview & re-entered on the CR1!!!

The medicals for K3 & CR1 are basicaly the same, cept for K3 you dont have to of had all your vaccinations, BUT you should anyway!!

You wont need a seperate police certificate as the one you just got is good for a year!!

Your CR1 interview isnt going to be for a while yet as you have to go through NVC, then once you get "case complete" at NVC you will have to wait another 2 months for your interview!!.........if you are in a possition to do both as i was then i would say go for it, it has a plus that would work great for you, I.E you would probably have your K3 intime for Christmas with your family in the US!!, you could still do all the CR1 paper work & return to the UK for your CR1 interview...........................the only other options are, abandon your K3 & stick with the longer wait of the CR1, while waiting in the UK, or get the K3 & AOS in the States!!

well alittle "Tip" on getting your interview before Christmas.......when the form asks what date you travel put a date in there, E.G i told them i was traveling 29th december i got my interview on the 16th :thumbs: if you dont put a date they seem to think there is no rush!!!!
