Hello everyone.

I'd like someone guide me on what to do with Nationality/Citizenship on Forms i-130, g-325a, i-485, i-765 and i-864.

I'm a citizen through marriage and would like to bring my mom (born in Argentina, then living in Israel for the past 10 years). My mom came to the States with her Israeli passport (USA visa on it).

I wonder what Nationality/Citizenship should be correct. Argentina or Israel?

I don't want to be inconsistent on the forms.

Thank you,

pab

*** Moving from ROC to AOS from Tourist visa for now ***

Where is your mother at the moment? If in the USA. is she legal?

It doesn't matter which nationality you put; in most places, you will declare both.

If she will do her paperwork in Israel and lives there as a citizen, use those details. Her Argentinian citizenship will be disclosed during the process to no prejudice to her or the process.

Good luck!

My mom is in the US already since June. She is on a B1 Visitor Visa.

My concer is that she has the Visa stamped on her Israeli passport (2nd citizenship), but she was born in Argentina.

Still, it is not a problem. It is not illegal for her to have dual citizenship. As part of the process she will have to disclose her Argentinian citizenship. It will not hinder her process. Also consider that if she lives in Israel she will have to do her paperwork there and she will have to present proof that she is in that country legally.

If she were living in Argentina, it would be the inverse case.

Chances are that during her process to obtain the B1 visa she already disclosed that second citizenship to the consulate in Israel.

Consider that it would be deemed fraud for her to enter the US on a tourist visa with the intention of remaining in the country through AOS. So long as she respect the duration of her allowed stay she 100% within the law. She is not doing anything wrong.

Does she have dual citizenship?

Does she maintain both Argentinean and Israeli passport?

If she acquired Israeli citizenship and relinquished her Argentinean citizenship than she is Israeli citizen.

Most forms have room to put in your previous citizenship records, make sure you complete that portion.

Since she entered on her Israeli passport with a visa issued at the consulate in Israel, her "main" citizenship is Israel for this application. Both citizenships will be disclosed.

AOS for my husband

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!
