Lawyer help or not??

Hi.

My wife and I have a pending I-130 going on at the moment. We have been approved by the USCIS, and they have sent the case to NVC...and that is where we are now.

So far we have done this without a lawyer...but my question is, if it in any way will speed up the process of our case if we get a lawyer to take care of the rest of the process for us, or is it just a waste of money??

If you were patient enough to get this far you should be fine. This website can assist you through the process. Waste of money IMO.

My opinion - based on reading numerous cases here on VJ - waste of money and TIME.

Having a lawyer will probably actually slow you down, as YOU have to collect all the required documents, then send them to the lawyer, who then sends them to the NVC (you hope - there have been cases where the lawyer has taken the fees but never sent any paperwork at all). Having a lawyer won't make them process your case any faster.

By doing it yourself, you know exactly what is going on, when everything is due, and can send everything as soon as you are able.

18 Apr 2011 - APPROVED!! NOA2 text and email

NVC

29 Apr 2011 - Case entered into the system/Case number assigned; Medical Exam in Sydney

30 Apr 2011 - Police Check Application sent

2 May 2011 - Called NVC and got Invoice ID number

3 May 2011 - Sent DS-3032 email

4 May 2011 - Received email reply from NVC for DS-3032; Received Medical Exam results

5 May 2011 - AOS invoiced and paid

7 May 2011 - AOS package sent; IV invoiced and paid

9 May 2011 - AOS package delivered to NVC according to tracking

20 May 2011 - RFE for missing IV package....still waiting on Police Certificate!

24 May 2011 - Received Police Certificate after 25 days (so much for 7-10!); IV package sent

27 May 2011 - IV package delivered according to tracking

8 Jun 2011 - RFE for original marriage certificate; requested supervisor review since we KNOW it was in the package!

30 Jun 2011 - SIF and CC - FINALLY!!!!

13 Jul 2011 - Interview date assigned! Scheduled for August 9th @ 10am

9 Aug 2011 - Interview - APPROVED!!!!!!!!!!!!!!!!!!!!!!!!!

12 Aug 2011 - Visa in hand

24 Aug 2011 - POE @ LAX

Absolutely a wate of money to obtain a lawyer and it most likely take longer because your case is not always the lawyers priority on a daily basis.

If you can read and fill in the forms correctly, you are all set. No matter what, you still have to obtain all of the necessary data to provide to the NVC.

Visa Journey has a lot of examples on how to do everything. Read them over and over until you are confident enough to proceed.

The forms are fairly straight forward.

The only time an attorney would be recommended is when one of you have a questionable history that needs to be reported. For most of us, that is not an issue.

Having an attorney will not speed up anything. If you went through the USCIS and got approved without an attorney, and you have time to research on your own, I am pretty sure you can finish it without an attorney. We got an attorney involved in our case bc of our busy schedule at the time when we started. Still, we did our own research and in most cases the attorney was going with what we found out from our independent research. So, hire an attorney if you have no time to research and do it yourself, but still get step by step updates of what the attorney is doing and compare with your independent research...Never leave it entirely in the hands of an attorney thinking that an attorney should know it all.

Haha...thanks. I think we'll skip the lawyer then....and save the money.

So far we have been able to work everything out on our own...and we already sent the DS3032, and just put myself as agent....and got notice today that they have received the form.

But we are getting a impatient, so we basically wanna do anything to speed up our case, but I guess we just have to be patient, and let time work for us.

Lawyers do nothing or will do exactly what u did. In my case, I got a RFE from the USCIS and paid her $2500.00 to guide me, instead of guiding me, I was the one who instructed her how and what to do. The only thin she helped me with the cover letter. I gathered all the documents requuested by USCIS and arranged them in a file and gave it to her. She didnt even go throuhg it or read it. She just took the folder and put the cover letter ( one page costed me $2500.00) and dropped it in the mail. 60 days passed from the day they got my response to the RFE and I called the UCSIS about my case and they told me to wait for another 30 days and call them back. I talked to the same and she asked me to pay her another $1500.00 to do a researh ( may be she is going to google it and find out what to do )
