I think everyone is jumping the gun a bit here..............

I think he can do more than just pack up and leave!

If this story is as "one-sided" as he says it is, then he has some ammunition.

If he is legally married to this USC, then he needs to get legally divorced before he leaves the country. I believe that most judges would award him money from his "wife" if he can prove that she did this just to get 25K from his family.

I agree that chances of staying in the USA are slim, but he should at least try to recoup the money before he leaves.

jaysonronny; find some free leagal aid, and sue for divorce. If you can substantiate your claims regarding this story, I think you could get a judgement against your soon to be ex wife.

I am so sorry this is happening to you.

I don't have much advice, but can you get any of the money back from your wife? Could your parents help you?

I guess it all depends what you want to do, do you want to stay or go home?

If all else fails the Chinese embassy should be able to help get you home.

I really need my wife back and at the same time i dream about going to college everyday and night, but everything were ruined by my wife.

I'm so hopeless in my life. :(

Exactly. Start looking at air fares.

I will need to sell my laptop and other thing to get money for ticket back home.

Is it possible if i want to come back again on student visa, k1 visa?

I have my brother living at another state and he is a USC. Can he sponsor me and come back again in the next 10years?

Does anyone find it odd that an investigator came to the house and gave the OP the opportunity/advice to withdraw the petition? It seems that if USCIS thought someone was guilty of visa fraud especially after a home visit they wouldn't be interested in protecting the applicants ability to return to the US.

OP- Did the person who came to your house use the acronym "INS" to identify themselves? How do you know what went on at your wife's house? What was the email address of the investigator who wanted you to cancel the appointment?

He can get a divorce in his home country. It doesn't need to be done in the US. In California, it takes at least 6 months ti fet a divorce. USCIS will continue to move forward, so a pending deportation would complicate his life in the US. In addition, how is he going to support himself (he already had to sell his stuff to eat) without the legal right to work?

A lawyer will want at least $5000 to take this case. Even if he wins, he will lose. How much of that $25,000 is gone? How much will the lawyer take? How much will he get back? My guess is she spent the money already. If she is a scammer, the money is gone and she has no other assets to go after.

Possibly OP, the best thing to do is speak to someone like a lawyer who is proficient in these things, though I understand paying for one may be out of the question.

Talk to your parents, see what they advise ( parents always seem to know best when we need help).

If you can, try to talk to your wife.

If all else fails, parents, wife, legal aid, go to the consulate and tell them your story and that you need to get home- they WILL help you at least to get home.

I nerver heard an investigator came to a house n said they are going to help us or anything. I should have gone through fraud interview room n put a handcuff on my hand n go to jail. I'm so hesitate about that at first coz I think my wife n his boyfriend ask somebody to play this trick with me. But then when i have an appointment with an investigator after my wife told him everything I saw his car license plat is a government car. They wear like a blue uniform n he asked me if I'm commited fraud or not? N there is a man standing right next to me keeping looking at me n noting what I said.

He said I gave my wife money to marry her n get a green card. N he told me to withdraw my i485 or keep going through? He want me to make a decision n email him then he will take care all of the paper. I want to talk to my wife if she is willing to come back n live with me but she didn't pick up my phone call anymore. I can say there is no way to make my first marriage life work anymore I'm so disappointed about that. I'm going to email an investigator n withdraw i485 next week. I really have no choice.

I should have known my wife only want money from me since we were just married. After we got married on january 23rd, she don't want to file for i485 for me at all. She said i have to wait for case number or sth that is not really is. As i did my research online i know i can file i485 2weeks after i got married. Until April 24th she agree to sign the paper for me. It took me 3months for just asking her to garder document related to her. I cant imagine she is trying to drag my time 3months for just a thing that could be done within 2 or 3 days. She said she will take care of all the paper work but she did nothing. I'm lucky that I can understand some English n read English or otherwise I could be worst than that. I did the paper work n ask her to sign for me coz I don't want to stay home all day n night for nothing. I need to go to work for money to pay rent n to survive by myself. I have gone through this bad situation until I got all the paper work n sent out to uscis in Chicago. I got biometric n I got interview schedule I'm so happy when I know I can go to work n see new world. Finally there is another big trouble coming again n it is over my ability to deal with. I'm so so so hopeless right now... I'm getting stuck in the middle of nowhere. Thanks for reading my story......... N thanks for any advise u gave me....

Can i apply for student visa and come back to usa again? i really want to access to education in here.

If not, can i apply for student visa to canada from my own country?

This question has already been addressed. If, in fact, there is a fraud determination, you will need to leave the US and you will unlikely be given another visa to the US

Not sure what Canada has to do with your situation at all. It is a completely different immigration system than what they have here, but you can always try
