Anybody can answer my question?

I am just little concern of this friend of mine about her visa status. She went to US using Fiancee visa (means her and her fiance need to get married within 90 days) but then they decided not to get married yet, instead, the lady went back to her country to finish something (so she didnt have greencard coz they didnt finish the 90 days). And then i just heard that she is coming back to US again using fiancee visa(the same guy), she said she will have her interview this month. Now my question is, is it possible for her to come back here in US even she already came here in US for fiancee visa but they didnt get married?

K1 Timeline

01/16/09- Michael joined Internationalcupid. sent me a message..

01/16/09- started communicating through email only.

01/21/09- (my b-day) started using instant messenger

02/17/09- decided to come in PI to meet me.

02/19/09- booked a flight and hotel

03/02/09- arrived in PI (his b-day)

03/06/09- Goodbye my love, flew back to Texas

03/18/09- hired a lawyer for K1 Visa

03/25/09- sent G325A and other documents to love

03/30/09- love received the forms.

04/07/09- sent the forms G325A, I129F and other documents in checklist to our lawyer

04/09/09- lawyer received the forms and docs.

04/17/09- lawyer sent it

04/29/09- NOA1...case number received.

08/06/09- Love's 2nd trip....SOOO HAPPY..

08/14/09- Went back to US

08/26/09- NOA2 email

08/29/09- NOA2 hard copy

09/02/09- NVC letter received

09/22-23/09- Medical

09/29/09- Interview passed.........

10/14/09- Arrive in Texas

11/25/09- wedding day..

11/26-29/09- Honeymoon in Vegas..

12/02/09- applied for ssn..

12/08/09- received a letter from SS.. card will arrive in 2 weeks..

12/16/09- SSN received..

01/06/10- AOS application submitted..

01/15/10-3 Receipts received..

02/02/10- Biometrics at Lubbock

4/26/10- Received my gc

same guy? new I-129F petition? no problem.

She would have voided her I-94 that she received when she arrived on the first K-1. They would then have to start all over and refile. A greater amount of time and money lost. They might have had to explain some details about the first visa when she had her second interview, but there is no automatic cause for denial.

The fact that she is again scheduled for interview this month, then, I think she would be fine... because same guy.... and once you get to interview stage, that means, USCIS approved the petition already. But, she might be ask to explain why she came back home during the interview -- which she should be ready of explaining. One good point is that she came back home before her 90 days expires. This is rare, but this could happen. :)

Yes if she didn't overstay on the first trip, it shouldn't be a problem. They might ask her what happened, why she didn't get married the first time, but that's about all.
